Hi there VJ'ers,

Long time no see. I'm starting to think about the removal of conditions/10 year GC process even though it is still about 4 months away for me. I have kind of a dumb question though and have not been able to come across the answer yet...

Do you have to do removal of conditions/apply for 10 year GC first or can you go straight to applying for citizenship? I went through the K1 process and will have been married three years this July. I thought I remember reading somewhere that if you had been married 3 years to a service member (husband is Navy) that you can apply for citizenship after 3 years. I am definitely on the citizenship path as I have two little ones born here in the past two years that are American Citizens and as their Mommy I do not want to risk any possibility of immigration issues that may separate me from them, especially if/when husband is deployed. We travel a lot between Canada and US and I'm always nervous that for some stupid reason the border guards will let my babies in but not me.

So I guess in essence my question is what is the quickest path to citizenship?

It also seems like a waste of money and time to have to get the 10 year GC first if I'll be applying for Citizenship only a few months after......

Jun 25/09 - Green Card Production ordered - Finally after 10 months!

June 30/09 - Received welcome letter!

July 10/09 - GREENCARD! - All done for a bit now!

May 20/11 - Sent in I-751 for removal of Conditions

if applying on the basis of marriage you must be a lawful permanent resident for three years. meaning you must have had a green card for 3 years AND still be married to your usc petitioning spouse otherwise the timeframe is 5 years. note that your window opens 90 days prior to the 3 year approval of permanent residence.

when you remove conditions, and get approved, you get ten year green card,married three years you can file for citizen ship,minus 90 days,there is a military hot line 1-877-247-4645,military and family assistance with immigration questions,, good luck,

All marriage based petitions are 3 years regardless of who you marry. And yes you will have to submit the removal of conditions. The cases that you are thinking of are when people are married for over 5 years. Usually this will be US service people abroad and the spouse is married but living overseas (or on base) with their US service spouse. When they return to the US and have been married over 5 years, then you do not have to file for the removal of conditions and can go straight to citizenship...
