Ecuador interview CR1 - Does my wife need another I-864 form by me?

This if my first time posting but this site has helped me so much I cant thank you enough.

My wife has her interview in two weeks and we are making sure we are well prepared.

Here is what a recent guide I read mentioned I needed

Interview Forms / Items:

1. Valid Passport.

2. Original or certified "long" birth certificate. *

3. Original adoption decree. (if applicable)

4. Original or certified copy of the marriage certificate. (if applicable)

5. Original death certificate. (if applicable)

6. Original divorce decree. (if applicable)

7. Police certificate. **

8. Court record(s) (if applicable).

9. I-864 Affidavit of Support Form along with past 3 year U.S tax returns (or transcripts) and any other financial documents required. (see poverty limits here)

10. Court and prison records.(if applicable)

11. Medical examination information

12. Two passport-type photos (see specification) of the spouse or benefitiary

We have everything ready except item 9. I already sent in the I-864 with 3 years tax transcripts and employer letter to the NVC. Does my wife really need to bring copies of these to the interview? I dont have the 3 years tax transcripts, I would need to make yet another request. Why am I force to do this yet again?

if you will be able to get copies for her before the interview, it's better to get them still.

while you already sent those there are times when COs don't want (for many reasons) to check what's in your submitted docs and prefer to make things convenient for them and ask for those during the interview.

now, if you won't be able to get them in time for the interview, request for them anyway, (you'll still need them in the future) and tell your wife to explain that those were already submitted. if you're lucky, they will check your docs. if not, then the worst that happen (as far as the i864) is that they'll approve her visa but will ask her to come back with the docs before the visa is issued to her.

I guess that means I need passport photos of myself sent to her then.

Also I just went over the mail she got for the interview here is what it says:

Visa Interview Requirements

"WIFE NAME" must bring the following to the visa interview:

* Any original documents that were requested by the NVC but were not submitted

to the NVC

* The medical examination results if not submitted to the Embassy/Consulate by

the physician

* The correct size and number of photographs

* Valid passport for all traveling applicants

Looks to me like my tax info is no longer needed but I dont want to take any chances...

All they are really wanting is another set of documents if alot of time has passed since you first applied. Some applicants may way many, many months therefore their financial information may be outdated to some extent. The CO may ask for updated information so it's best just to copy your original form and have at least the last three pay period receipts from the sponsor. If your visa has been standard it's probably not needed but better to be safe than sorry. Good luck on your interview.

You didn't mention the most important thing: Are you bringing yourself to the interview, too? If not, I regret to report that refusal of the visa is a very high likelihood. They DO not and WILL not tell you this.

Go to the U.S. Consulate & Embassy forum here and read the thread "US Consulate in Guayaquil, Ecuador" in its entirety.

Had there not been (beyond all hope) a couple of stray approvals of "solo" interviewees recently (which may be anomalies), I'd be offering you deepest sympathies right now. As it is, if I were you, I would spare absolutely no expense to beat it down to Guayaquil to be there at the hellhole when your wife is to be interviewed.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Don't forget that there is a form for the CR-1 interview that you can download from the Ecuadorian Consulate's website that your wife should fill out and take with her. I don't remember the name of the form but it requests the information of all of her family (parents, siblings) including date of birth and their US-visa holding status.

TBone thanks for pointing out that thread for me. That thread scared me to death!!! I cannot make it to the interview but thought it was ok since everyone I know (about 3 people) who have done the CR1 visa did it solo with no problems at the Guayaquil consulate.

Reading from that thread, I noticed some differences between our cases. Yours is a fiance visa which I would think is harder to prove (no wedding pictures). Also the rejection seemed to be from lack of evidence. We have financial documents, a wedding reception, church ceremony and I have been to Ecuador more than 13 times since we met (once every 2/3 months) and she has a copy of my passport to prove it. We have traveled to other countries together as well. I hope this will be enough :( but now I am consider taking a trip this weekend and ditching work.

Si, man (sigh, man). I know Te Amo Ecuador well, and he lived with his wife and was still run through the wringer multiple times. Beyond that, read PDXBicycleBoy's embassy review for even more thrills, si man.

As inconvenient and expensive as it might be for you to drop everything and go now, at least you can avoid being blindsided as so many of the rest of us were. You may never learn whether your presence tipped the scales toward issuance of the visa, but as long as she gets it on this, the first try, your efforts will have been well worth it, si man.

Also, be sure to be in Guayaquil a full day before the interview's purported day & time. At least one other VJ member's fiancee received a call from the Hellhole at 9:30 a.m., saying that their 2 p.m. interview was "now" 10:30 a.m. (that same day) and the visa would be refused if they weren't there. Fortunately, they were already in Guayaquil and managed to make it. (Nonetheless, they got hosed in the same manner as the rest of us.)

Im guessing its the G-325 (Biographic Information) which we already sent but they may want an updated copy of. Non-immigrant visa folks require: DS-156 but that's K1/K3, not CR1/IR1 which are Immigrant visas.

This form, I'll have to look for the name of it, is not for NVC at all and is NOT the G-325. You have not already completed it and submitted it because it's specific to the Guayaquil Consulate. When we were waiting for the interview a Consulate rep came around to make sure that we had completed said form. He had extras in his hand so maybe, if they are still requiring this form and you can't find it online, they'll give you a copy there. My husband is from a big family so it wasn't something we could do off the top of our heads (birthdays, birth places, etc of parents and siblings along with any visa information/dates).

The only place I found it before was on the Consulate's website. But since it's now been 2 years since we went through the process, maybe they no longer require it.

:D My wife was approved today!!!!

Thank you all. I didnt make it to the interview but it all went smoothly. They told her DHL should receive everything in 4-8 days which is perfect because I had booked her a ticket (flexible one) for the 25 so she can spend Xmas-eve with her family.

Im so happy! This site helped me so much I dont think I can ever repay it. Thankfully I didnt hire a lawyer and instead educated myself through this site :)

They did give my wife some problems with her photos telling her its too far away (which it wasnt). She had to go out and retake the photos outside and come back in.

I think her interview went smoothly thanks to all the visa journey folks who fought hard to improve the situation there. Thank you all once again.

Note to future Guayaquil interviewees: The recent few approvals-without-petitioner-present lend some hope, si man, but I'm not prepared to recommend any let-up in caution, no man.
