Hello there,

My Aussie husband and I are wondering if we will need a co-sponsor. I will have made just over the poverty guideline (for a household of 2) in 2010, and he has over $60k in his savings account (might be more by the time we apply in a couple months). Will his $60k count as enough assets to help us meet the requirements for a household of 2, or will we need a co-sponsor?

I'm also curious about this, although I know it makes no difference to our case: I'm self-employed, and in 2009 I made just over the poverty guideline before deductions - I've heard that's what they look for - not after deductions?

In any case I already know we'd never meet the requirement based on my income alone, so we are hoping that his savings will suffice. It looks like we can list it in Line 28a.

He needs to submit an I-864 when it's time and 3 years of back taxes to show

proof of income for the petetionier. They dont count your income under the

I-864 only his, or who ever is the petetionier.

If he dont make enough and dont have the 3 years taxes, he could need a

co sponsor. What's in the bank helps but it not the rule that make the case

or give and apporoval.

Who's the petitioner? It's the petitioners responsibility to prove his or her

income meets the 125%. NEXT UNDER THE I-864. The petetionier has to show 3

years back taxes above the 125%. It not the combined 2 incomes to qualify.

its the petetionier job to prove they can support the beneficary. And they

use the 3 years back taxes to see if they can as part of the process.

Read the instructions for the I-864 for go to google type in I-864 instructions

and it give you the info what is needed to be a co sponsor or if you have get one.

To clarify, I am the US citizen and therefore the petitioner/sponsor.

We want to know if his assets (not his income), as entered in Line 28a, plus my income would be sufficient, or if we will likely need a co-sponsor.

If anyone has any opinions, please let me know. I know that no one can know for sure (?) but there seem to be many knowledgeable people on this forum who may have some insight.

As long as you have met the poverty guidelines you will be ok. His assets, if used, would be at a discounted rate (I am sure another member will state the exact rate of discount at some point today). If you are so close and want some insurance consider getting a co-sponsor for him.

As long as you have met the poverty guidelines you will be ok. His assets, if used, would be at a discounted rate (I am sure another member will state the exact rate of discount at some point today). If you are so close and want some insurance consider getting a co-sponsor for him.

I just realized that technically his assets will be my assets by the time we apply, because we are adding my name to his accounts soon.

Does that mean they will count for the full amount?

If so, then I imagine that should be enough to get us by without needing a co-sponsor. I'm hoping so anyway, because I don't want to ask someone to co-sponsor if we don't really need one...

Perhaps I should add that the $60k in our bank account is currently in an Australian bank in Australian dollars, since this is where we live, but after we get to the US we can transfer it to a US bank in US dollars.

Hi

Your going to still have to file a I-864 after approval, not 100% you or you wouldn't

still need a co sponsor. Be sure they will let you konw at the US Embassy for sure.

if you dont qualify. After they see everything and papers about all they will let you know

Good Luck, just make sure you have good doc's for 3 years back taxes to be safe for IRS to

show them.
