Here's my situation and I really need help.I just recently got back from the Philippines last September 2010 because I studied there for my Bachelor of Science of Nursing.On October 7,2010 I sent out the petition for my fiance.I just took my Certified Nursing Assistant Exam.Since, I've never had a job before and nevered filed a Tax return.Hopefully,this month I'll find 2 jobs and make more than the 125% proverty.I still live with my parents.What Affidavit of Support would I submit when the time comes when my fiance is set for an interview by April 2011?How about the last 3 years Tax Return that I need to submit?I can't have my mom as my Co-Sponsor since US Embassy Consulate in Philippines doesn't allow Co-Sponsor right?Please help me out here.I'm really worried.

If you check the phil forum, you will find that while many say the consulate there doesn't accept co-sponsors, many also prove that it does, especially for situations like yours if you will apply soon (fresh graduate, but ready for employment)

If you are confident that by the time she needs you to send her the affidavit of support you'd have 2 incomes and would be above the poverty guidelines, then you don't need to have them as co-sponsors. but if i were you, i'd have them on my application, to show that while you are (by then) able to support your fiancee, you have your parents to back you up, in case something happens to your employment.

What application is that?So, if I have 2 source of income and meet the poverty guidelines i would need to feel in 1 I-134 form right?How about the tax return?Isn't that one of the requirements for the affidavit of support which I nevered filed one.What will i do?

How about if I don't make the poverty guidelines?Meaning, I would need my mom as my co-sponsor right?What forms do I need to fill out and my mom?

The application Zen Den is talking about is the I-134 Affidavit of Support that you are required to complete and send to your fiancée. Your fiancée will submit your I-134 Affidavit of Support (and all of it's supporting documents) to the Embassy when she goes in for her interview. If you plan on using a cosponsor, your cosponsor is required to complete a separate I-134 Affidavit of Support, including all of it's supporting documents. You will send your cosponsor's I-134 Affidavit of Support (and it's supporting documents) to your fiancée, and she also will submit it when she goes in for her interview.

If you don't have any income by the time of your fiancée's interview, her chances of a visa approval are likely slim to none even if the Embassy accepts your cosponsor. Your best bet is to get a job which pays over 125% of the poverty line for your household size and for the area you live in. As Zen Den said, if you have a job which pays over the poverty line, you will qualify on your own and you won't need a cosponsor.

As for income tax returns, you can always file them retroactively. You will want to submit at least your current income tax return (or tax transcript) to the Embassy. Also, once the IRS has processed your income tax return, you can order a tax transcript from them for free.

If you get a job soon, then by the time of your fiancée's interview, you will be able to include several paycheck stubs along with your I-134 which will show the Embassy that you have a current sustained income that will put you on a trajectory of having an annual income which exceeds 125% of the poverty line.

For filing retroactive income tax returns, check out the IRS website.

The I-864 comes into play if you decide to use a cosponsor. You can have your fiancée try to submit your cosponsor's I-864 (rather than an I-134) to the pre-screener or the consular officer at her interview. A friend of mine used his brother as a cosponsor at the U.S. Embassy Manila, and his cosponsor used an I-864. My friend's fiancée got her visa. The cosponsor's I-864 may have been an unorthodox method, but it worked. I have seen another VJer do the same thing.
