Hi Everyone,

On the I-485 form there is a question that asks "Were you inspected by a US Immigration Officer?" Does this mean at the POE did the Immigration people ask questions or does this mean that there was something weird and an inspection was required?

Also, I already filled out the I-134 Affidavit of Support form for the K-1 visa....I'm assuming I need to fill out the I-864 form as well?

And, for the medical part.....obviously we did the routine K-1 medical portion previously, but now we need additional medical too! Where can i find the list of doctors in Florida?

one more thing....Is the EAD work permit only good as long as the visa is good? or can it be used until we receive the Green Card?

If you pass legally through a POE and you have your I-94, you were inspected.

You complete the I-864 for AOS

If your medical you had for the visa is less than 1 year old, you will not need another one, but you may need a vaccination supplement. You can get a list of civil surgeons in your area on the uscis.gov website.

The EAD will be good for 1 year. Your visa was good until you used it at the POE. Your new status will be pending AOS until you are either approved or denied adjustment. If you don't have your GC by the end of the 1 year the EAD is valid, you will have to apply for renewal.

All the answers above are correct. The reason that this question is phrased in such a strange way actually has nothing to do with USCIS and everything to do with the inartful way Congress drafted the statute that governs the issue.

One of the statutes that governs your eligibility for adjustment, 8 USC 1255, specifies that your nonimmigrant status can be adjusted to that of a person admitted for permanent residence if you were "inspected and admitted or paroled into the United States..." 8 USC 1255(a). This means that you must be able to affirmatively answer that question or USCIS will be statutorily REQUIRED to deny your AOS application.

8/11/06 Married.

8/15/06 Received marriage certificate.

8/16/06 Overnighted AOS and AP applications (no EAD, since I won't need it until next year).

8/17/06 Delivered at 12:44pm (Chicago lockbox).

8/24/06 All 3 checks cashed.

8/26/06 Received NOA. I485, I130 and I131 are online.

8/29/06 All 3 touched.

9/2/06 Biometrics appointment received.
