hi all!!!

i am getting all my husband's informatio pulled together and have a very likely stupid question. do i need to submit our 2007 and 2008 taxes again? i submitted them with the aos files. will these jokers have kept them and i just need to send 2009?

ROC Timeline

18 NOV 2010 Sent 1.8lb packet to USCIS in Laguna Niguel (day 1)

For ROC, you need to send in the past two years, so that would be 2009 and 2008. What they need to see is that your status is married filing jointly or married filing separately with the same address as the return address.

N-400 Naturalization Timeline

Could I tag along with a question...? 0:)

It is not a problem if we filed separately, is it?

Do we need to attach both our returns (my hubby's and mine) or just mine (the immigrant spouse)? I was thinking both would make sense..

I'd prefer to file separately. I think what USCIS wants is documents that have both your names and address on them. But filing jointly would probably be a plus just as joint credit card and bank statements are a plus because they show joint responsibility. I'm sure others here would know better since I've yet to do ROC. Good luck!

From what I read on this forum, I believe it wouldn't be a problem if you file seperately, as long as you send in both and they show the same address for you and your spouse.

Filing separately for financial benefits is an understandable approach. As long as you indicated on your return that you are married, entered your spouse's information at the top of the form and have the same address then there should be no problem. You do need to include both returns to show that both of you have filled in the returns as any married couple is expected to.
