I am wondering if anyone has had a hard time from their medical doctor with regards to a drinking history, I have a drink history but no longer drink, I have had my medical and been upfront about it and now the Physician is giving me a hard time. I had a non-immigration medical in 2007 and was refused even though I had a visa in 2006 and went to America without any hitches, I am now immigrating to the USA to be with my wife.

I had a call from my Physician tonight asking why there are discrepancies in what I told her this time to what I told her last time, I said I don't exactly remember because it was 3 years ago but she is really giving me hard time about my past, doesn't seem to care about who I am now, what I have done to become who I am today, it feels to me like she is getting personal, she actually went out of her way to pull my medical report from three years ago!!! when I had done my medical last week and gone home.

Has anyone had experiences of this? please tell me my hard work and honesty isn't going to get my visa denied because this Physician can not or will not let MY past go?

Do I need to legal assistance about this? is this Physician allowed to make this personal... she even made the statement "I see 100's through here every week trying for a visa in to the USA, fed up of it frankly" surely she is making it personal and not doing her job?

Maybe I am bang off the mark... I just don't know anymore

It would seem to me, based on tehf acts you presented that she is being pretty judgemental. My fiance has a long slice on his forearm. They instantly asked if it was a suicide attempt. It wasn't. He broke his arm, it went through the skin, and he had to have surgery to get it repaired...oiy.

Do you have anything showing you've been to programs to help with drinking, or anything that would show you have made progress? If so, I would start gathering proof of that, letters, and whatever else you need to show you no longer drink.

I actually presented to her a letter that I obtained from the rehab center I went years ago, I have no documentation on the times I went to AA because I never thought I would require them, I did how ever go to my GP over a month ago and asked her to perform a test to prove how my liver was or at best to give evidence of any mistreatment of alcohol recently, My GP faxed the LFT (liver function test) to the physician Friday last week and she has the results which I know is clear but she still phoned me to grill me, it was hard enough over coming my fears in the medical let alone trying to reassure the Physician I am clear of drink.

It is like she is on a personal crusade to ruin this for me.

mate, as I was leaving I mentioned I had a medical before for a k1 visa - and then the dr started asking if i ever used the visa and one or two other questions. Whether its protocol for them as their organisation, or whether the USEM instruct them to triple check everything I dont know, but I wouldnt be surprised.

have a look at the site i mentioned mate, www.immigrate2us.net

and in the laurel scott section on the forum, leave a question for her, shes a top immigration attorney. If you ask your question, be as straight to the point as you can, so that she gets more time to answer rather than reading a long post, she may be able to help you - at the very least if you get it in now, you will have an even stronger idea of the USCIS side of the situation before your interview.

The good thing is you've been honest about it - so you cannot have a misrepresentation charge thrown at you really, for any answer that may differ.

Thanks Richi, will take a look now... so upset right now... I feel victimized by the person, years of doing the right thing is only making my life worse... I have never met such a closed minded arrogant person as this doctor, I never imagined my life's dreams would be compromised by one person with an over inflated ego, I know they have a job to do but for crying out loud, why can't a man make a mistake, learn by it and be rewarded by decent treatment.

I may not be seeing very clearly right now, all I have is this feeling that a woman (no offense meant to woman it just so happens this physician is a woman) is looking at me as a piece of ###### and laughing in my face because she has the power to do and say what ever she pleases, I am a human being trying to obtain a visa to be with my wife and all she sees is a visa number and a man who drank, not once did I sense a breath of compassion and understanding of what I have been through to get here... I feel powerless and controlled by her, it sickens me to think about her and how she appears to take her position as a god given right to pass judgement on people based on records.

I know I still the interview to plead my case but why do I have to be put in a position of defense for it when all I have done is be as honest and forthright as I could, I have learned a heavy lesson this month, to be a good person and be honest is not how you succeed in life

There was a woman whose husband had an issue getting past the visa medical because her husband said he had a lot to drink the night before (or he answered how much per week and she was asking how much in one night etc). She had a few different threads going on about their process, and it actually was a big mess because they got denied and had to have their waiver go through the CDC or something.

I'm not having any luck finding her postings, but I'm sure they are on here somewhere. :( Maybe some one else remembers her username...

Thanks for this, I'll give them a nudge today, see what news they can give... I guess when all done it is up to the CO in my interview... I said to Richi earlier today that I now have a defeated mind set, that way I won't feel so heart broken when they refuse my visa, but I will be making a complaint about this physician, it seems to me a misuse of power and personal interests on her part may be the reason for my rejection.

I will never apologize to her for being human, I made a mistake or two years ago and paid for them already, who gave her the power to continue to punish me.
