Timeline

My wife is Canadian; we recently got our NOAA-1 after filing the I-130; we both cross the border frequently, visiting each other. I was wondering what affect applying for a NEXUS card would have on the process.

06.Oct.2010 sent I-130

13.Oct.2010 NOA1

02.Feb.2011 NOA2

08.Feb.2011 NVC rec'd packet

12.Mar.2011 DS-3062 rec'd/sent via email

12.Mar.2011 I-864 billed

14.Mar.2011 I-864 paid

17.Mar.2011 IV billed/paid

27.Mar.2011 DS-230 sent

28.Mar.2011 I-864 sent

04.Apr.2011 DS-230/I-864 rec'd at NVC

17.Apr.2011 NVC inquiry--DS-260 requested & sent online

18.Apr.2011 DS-260 accepted at NVC

26.Apr.2011 NVC inquiry, original document requested

28.Apr.2011 NVC document sent

13.May.2011 NVC Case completed/Interview Date assigned

29.Jun.2011 DOS Interview--Approved!

Timeline

I would probably wait to apply for a NEXUS until after she gets her Green Card. While she is going through the immigration process, there is no guarantee that she will be able to enter the US. It is up to the discretion of the Border Guard. Applying for a NEXUS makes it appear as though she believes she has the right to enter without questioning, and it could leave a bad taste in their mouth and flag her in the system for future crossings. I wouldn't rock the boat at this point in the process.

Applying will have not impact on the immigrant visa process. However, since people with immigrant intent are not eligible for nonimmigrant visas, I doubt they are eligible for a NEXUS card either.

Facts are cheap...knowing how to use them is precious...
