hello,

i need some help- this is my story

i am married to usc for more than a year we apply for i-130 i-485 i-765 and i pass the fingerprint last week.

on 8/21 my husband grab me by my hair and threw me on the ground i call the police and he got arrested for simple battery.

on sept 16 i receive a request for more evidence for the affidavit of support (my father in low)

in the beginning my father in low say that he will sign again on the paper - so i ask my lawyer to prepare the form.

on 09-16 my husband got made that i am late to come home and he came to the place that i was whit a knife and my friends put him out of the place/

i went home to take my dog and my personal staff and we continue to argue and he broke my nose and got arrested again- and i had a surgery .

than his father say that he need to see what will happen in court and that i need to make sure that he son will stay out of jail.

he also ask if i will lay in court for him.

i need to be in court this Monday/

i want to apply for i-360 but i want to save my i-485 they give me 87 day to send the evidence/

i dont see in any forum case like my case because i alredy start a process but i am in the middle of the way/

please give some advise

morally,i suggest you dont buy into his #######,your husband broke the law AND your nose,he obviously has issues and is a danger to you and the society.if i were you i wouldnt feel safe knowing his out there.having said that i know it is hard ,nearly impossible to get VAWA before AOS approved so i suggest a lawyer.whatever you do,keep in mind the long term effects of it on you,and your life in the states.good luck

i move out last week now i feel safe my husband don't have my new address.

any idea if my i-360 is approved and i file a new i-485 do i need a sponsor ?

What!?!? VAWA is so that someone in her situation can Adjust Status without the abusive spouse.

If money is tight she should contact the local Battered Woman's Shelter, they can put her in touch with resources, legal and otherwise, to assist her in her situation. Catholic Charities is also known for helping battered women with lawyers for VAWA.

BTW, you really should contact the local prosecutor about the Father in Law, he is committing a crime by doing this.

It is perfectly legal for him to change his mind on supporting your AOS as a result of the problems in your marriage but for him to offer you compensation in return for perjuring yourself under oath in a criminal matter is a crime.

This is also further evidence of abuse at the hands of this man (and his family).

I am so very sorry for what happened to you! My heat broke.

I hope you find your answers. I do know you can continue and get the visa because you came here and married in good faith. In the future, be aware of controlling relationships (I only say this to help you). It is common for an abused spouse to then get abused by her next boyfriend/spouse. (It's almost like we pick them out without knowing).

5/01/09 Left NVC

5/15/09 Embassy Sent Packet 3 (we did not receive-they have correct addresses)

6/19/09 Packet 3 to Embassy

6/28/09 Appointment (packet 4) never mailed, had to ask to get email-they've got correct addresses

7/23/09 Interview Scheduled for 7:00am (A YEAR AFTER SUBMISSION)!!!!!!!!!!! APPROVED!!!!!!!!!!!!!!!!!!!

7/28/09 Pick up visa

8/11/09 She came to the USA with me!
