I-864 but only one W2 (relocated end of 2009)

Hi there,

I do hope that it will be my last question here as my package is almost done...Just need to finish the I-864.

but we do have a small issue. My Wife and I relocated from Europe in Dec 2009, so we do have only one W2.

What other documents shall we send to the USCIS? I was thinking about a letter explaining the situation.

Any idea?

My timeline:

10/2009 - E2 Visa delivered by the US Embassy in Paris.

12/2009 - Relocation in Big Apple :)

06/2010 - Mariage in France.

11/2010 - Assembly of package (I-130, I-485, I-765, I-131).

11/22/10 - package sent to Chicago (FedEx/Overnight.

11/23/10 - Package delivered to USCIS at 10:18 am.

12/08/10 - Received Rejection Notice of the package for incorrect fees.

12/09/10 - Corrected package sent again to Chicago (Fedex Overnight).

12/10/10 - Package delivered to USCIS at 10:08 am.

12/14/10 - Received emails/texts notifications of acceptance from USCIS.

12/20/10 - NOA1 received for I-130, I-485, I-765 and I-131(hard copies).

01/03/11 - Appointment Notice received - Biometrics appointment set for the 01/25.

01/25/11 - Biometrics done.

02/16/11 - Received Email: EAD in production, Post decision/Approval for AP.

02/26/11 - Received EAD/AP Card

03/28/11 - Interview notification received by email. Interview set for the 05/03.

A W2 is a wage statement provided by an employer. It is used when filing a tax return.

The I-864 instructions require a sponsor to explain why they were not required to file a tax return in each of the most recent 3 tax years.

Ok thanks, Indeed, we will include my wife tax return for 2009 and her W2 (even if she received only one month of salary for this year) and a letter explaining our situation. I believe it will be ok (hope so...)
