Timeline

can you update more on why your visa was returned/denied. I know of one person a long time ago who had the petition returned but it was sent back and it was granted. That was a long time ago and the person is not on here anymore. You can also post your situation in the Sub-saharan African forum, there could be some on there that have more experience with Nigeria. Sometimes, they don't even send the petition back so you have to be on them about that so that you can deal with it when it comes through here.

06/06/05 I-130 NOA1

06/14/05 K-3 NOA1

07/08/05 k-3 NOA2

07/22/05 K-3 leaves NVC to Lagos

08/08/05 Hubby picks up interview packet from embassy

11/17/05 K-3 interview (denied, C.O refused to take co-sponsor for k-3)

12/16/05 I-130 NOA2

01/03/06 NVC assigns case number

02/15/06 Case complete (thank you James Shortcuts- only 6 weeks!)

04/19/06 tired of waiting, filed k-3 #2 ( petition is still lost in oblivion)

09/11/06 NVC scheduled CR-1 interview/ on to Lagos (thank God after 7 months of waiting!)

10/14/06 Interview date (success!)

10/18/06 Hubby goes to pick up visa- not ready ( ugh what's going on!)

10/19/06 Visa in hand ( thank you God!)

10/29/06 Together at last :)

Whole process 1 year and 4 months

Yes they are saying we don't have a bona fide marriage and no martial relationship. We talk most every day or so by email, instant message, phone text, or phone calls.

You need to be specific and very clear on what the real situation is. Why would they say you dont have bona fide wedding? Its not just nigerian issue. Its a concern for everyone. Do you guys have lots of age difference? Are you of two "very" different backgrounds? things like that.....I just wanna know what can make a CO think a marriage is not bona fide.

the best I can tell you is to look up bona fide marriage i had to look it up myself and i am still confused on it. Nigeria is the tuffess country i am told to get a k-3 visa. But i am not giving up just trying to find some answers here as to what the next step is for us. They truly mistreat the people there I have seen it first hand. Do we get a Lawyer? I still have not heard a word from them my husband forward the paper on to me that they gave him.

I think they are saying that it is a fraud marriage. Did your husband give you the details of questions that were asked of him? did they say that you didn't have enough pics,e-mails, etc. If you know all the details then you could know which direction to go. I would say contact your senators, congress, and a lawyer to inquire about your case. You can also e-mail the consulate to ask for more details as to why. They have had some people bring back more evidence if that is what is needed.

Firs of all the consulate will not answer any of my questions refused to talk to me even in the very bigining. His first interview he was turned down because they wanted my divorce papers for my exhusband from American we furnished them in his second interview. His second interview went like this how often to you see your mother? Who in the wedding picture is related to you? We are sorry we can't believe anything you say to us. She leaves comes back and says We ae returning your visa petition back to the Department of Homeland Security office where it was approved with our recmmendation that the petition be reviewed for possible revocation. Any further inquiers should be directed to that office. The reasons are as follows.Evidences inditcates that this is not a bona fied marriage, no marital relationship exists and it was entered purely for immigration purposes.

This is of course is all bull we are married and it is as bona fied as we can make it We can not make love long distance. We had 13 days on our honeymoon in his country one we could not have had if I was not there. I spent 4 weeks in that country before we got married. We knew each other for over 5 years before he ask me to marry him We was engaged for over 5 months before we got married.

God how I miss him 15 months 16 days and 13 hours since we last kissed

i believe it is always in the best interest of both the petitioner and the beneficiary to both be present at the interview sesssion, although i don't know the full detail of the interview session. One thing you need to know about the nigeria embasssy, is that everybody that apply for visa are presumed to be a fraudulent person until you are able to prove that this marriage is legit. I don't blame them at all because alot of people have gone ahead of us and destroy other people's credible reputation. i know of a friend who applied for the KI VISA, at first they denied her the visa and rescheduled a second interview for lack of evidence, at the second interview, the husband(PETITIONER US CITIZEN) was present and they granted the visa. i hope this piece of information helps

My sentor's office even wrote them a email on my behalf and they have never heard a word from them and this was before the second interview.

If I had knew we had to prove we do have a Bona Fide marriage I could have sent them all we needed to prove it. But they only ask for a divorce decree and they had one and I resent them another and they never even looked at it. Just ask two silly Question as I stated in my first post. (How often to you go see your mother? and Who in the the wedding picture is your relative?) Which to me had nothing to do with anything.

His first interview all the women done was yelled at my husband for over three hours and poked fun of him and even had her other co-workers there sticking their heads out and laughing at him as well. To me it was not a interview at all but a lashing because we dare to be different in our ages and in color. But we are very much in love and we are married going on almost 17 months come the 23 of September.

I am not sure what the next step is for us. That is my question here. Now do we get somethng back from the Homeland from this point or do we get a Lawyer and let them handle it from here? I need my husband home now I am so tired of the six months this and six months that ####### they keep feeding us. :help::crying:

You know I understand all of this and I agree but I was unable to be at either interview not because I chose not to but couldn't go because I was sick the first one and the second interview was set for one day after he was notify, sorry but this was not long enough time for me to book a flight. If I had knew we had to prove we do have a Bona Fide marriage I could have sent them all we needed to prove it. Having worked for the State Department overseas, not Consular Section, I spent many months in both Lagos and Abuja.

With that said, they get literally hundreds of walk-in visa applicants, every day. This is one of the busiest State Department posts in the world, for a Consular Officer. That would make anyone weary of one applying for K-3 benefits or any other Visa benefit.

Further and more importantly, and to not excuse what appears to be a very disrespectful interview process, I suggest you contact a very competent Immigration Attorney. Your case needs professional help.

I have read posts from a number of people who have had problems with Nigeria. To paraphrase what one experienced immigration attorney once posted to an immigration board, 'the scale for immigration fraud at consular posts is low fraud, medium fraud, high fraud, Nigeria'.

I believe that anyone who is dealing with Nigeria needs at least a consultation with an immigration attorney who has had experience dealing with that post. Check the AILA web site to see if you can find any US immigration attorneys who practice there.

If I understand your posts correctly, you've been married to your husband for well over a year now but you haven't been back to Nigeria to visit him in that time? You are not helping his case any with this behavior.

Has any one been turned down in Lagos Nigeria and visa sent back to the states? If so what is the next step to get my husband here. We have been married now going on 16 months. Do I need to get Lawyer?
