Affidavit of Support Question

Hi! I have a question for a friend who’s filing for CR1 visa for his wife in the Philippines. He already received his receipt notice (NOA1) from USCIS and waiting for the approval.

He sold his business a few yearrs ago and even though every year he has a 1099 way over the necessary income limit. His taxes balance out every year so he doesn’t really show a high net income. He read that someone in a similar situation that has been trying for 6 years and has still not been approve. He has plenty of assets to show that he can support his wife. Has anyone here had a similar situation or know about this matter?

Is there any form or other requirements in addition to the I-864 (Affidavit of Support) that can be used in his situation?

Any advice would be greatly appreciated.

Income taxes are not considered regarding the Affidavit of Support. Not sure what that has to do with anything.

The I-864 is what is used. This person should read the instructions for the form to learn about using assets if income is not sufficient.

Its been so long since we were in this process but I'm goin try to recall, and someone correct me if I'm wrong.

Let's based the situation to both of you to avoid confusions.

Your husband should use the I-864 form , together with this form, he should present his ITR for the past 5 yrs (3 yrs will do), title for any properties, Only IF your husband didn't meet the poverty guidelines, That's the time your husband would need a co-sponsor who will need to fill out I-864A and the co-sponsor has to show ITR too to boost up the qualifications of the petitioner for the affidavit of support for the beneficiary.
