Hello,

My wife is about to send in an application this week for an AOS for me from an F-1 status.

She is a USC.

My question are...

1) Does she need to also include the form I-864 affidavit of support (Hers and a Joint sponsor) in the I-130 package? or just send it in the package containing the I-485 (The Help page just says in the I-485 package, but i have seen some people include them in the I-130)

2) Should the form I-765 have its own package or should it be placed with the package containing the I-485. What documents should accompany the I-765.

Please Urgent replies requested so we do not make a mistake as it seems different forms are sorted out in different departments.

Thanks.

Hi,

Think of it as 2 main forms like umbrellas. I-130 and supporting documents and forms, and I-485 and supporting documents and forms.

She will need to include the I-864 and any joint sponsor info and it goes under the I-485 umbrella.

The I-765 also goes under the I-485 umbrella.

Send it all together (I-130 and I-485 with all supporting documents) in the same package, not separately. You can separate them out with clips or whatever you like, but make sure they get mailed together.

Good luck!

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

Thanks a lot,

We were going to send the application together, same Big parcel with each application separated by medium-sized brown envelopes since we were thinking each application is handled separately.

I guess we would them separate by just clips.

Thanks
