Hello,

A friend of mine who is an active duty military met a girl online chatted and talked, he went to the philippines to meet her. Was there for 2 weeks to spend time with her. Now he went back here to the US and decided that he want to marry her. the whole span is just like a month. Can he file his petition already for a K1 visa? I know there is a requirement that is saying they should HAVE MET IN THE PAST 2 YRS, does that mean that they should have ongoing relationship or should i say establish the relationship for 2 yrs first before filing for K1 or can he file the petition now that he is back in the US?

GOOD DAY!!..it doesn't mean that they should have an on-going relationship for 2 years..whenever my fiance filed for our K1, we were just celebrating our 7th month..and whenever he went here last march, it was our 6th month of being a couple...hmmm..are they really sure about filing??well, i don't care whether they want it to be soon, but it's just that why won't they get to know each other so well and give few more time(3-4 months maybe..hehe..and also to gather evidences)..coz, honestly, the whole K1 process is not that easy and try to think about the expenses too!!(all other visa processing as well)...

ok :ot2: ..well,as far as I know(correct me if I'm wrong..hehe) there were no such rule on how long the relationship should be before you can file, just as long as they have met in person within the 2 years prior to their filing(a very important requirement)..and since, it's not two or even a year yet that they have met and they want to file as soon as possible, I guess they are free to file...but try to think of the other requirements such as affidavit of support(no problem maybe coz he is on the military) and proof of genuine relationship/engagement(another important requirement..EVIDENCES)...it's not only that the USCIS would just like to know that they have an existing relationship, but as well as they want to be sure that it's genuine/true...the proof they can have are emails,chat logs, phone bills and snails mails..even if they relly love each other, but they couldn't present to the USCIS enough proof about their relationship since their relationship is just new..they might get RFEs which might delay the process...the documents they will submit to the USCIS will be moved to the NVC then to the US embassy in Manila..as for that,I was asked during my interview @ the embassy if how long have we been together as a couple and how long do I know my fiance(other VJ members might have been asked about this as well.. :D )...

well,there's nothing wrong to try..if they want to take risk, then take risk..I always believe that it really takes time to know a person...and within that time comes patience..if they love each other, they would still think what is best at the moment and that is- to know each other well!!...hope I was able to help...TRUE LOVE CONQUERS ALL....Be blessed!!

There is no limit on how long you have to wait but just make sure you have sufficient evidence to prove you have a sincere relationship.

immigration officers may ask tougher questions and need extra evidence if they feel the relationship developed too fast. Unfortunately each officer is different and they are subjective.
