Hi

My fiance is incarcerated in Texas and we will be getting married by proxy. When I rang the US emabssy visa helpline,I was told that if he is a US citizen (which he is) and the marriage is legal,which it will be,we can apply as normal for my visa. However when he got the forms it states he must be present at the ceremony which is not allowed in Texas and cannot happen.

He is not due for release for a long time so please dont suggest waiting for that! :(

Has anyone any information,help or advice for us please? Any help would be greatly appreciated

You can also not file unless the marriage has been consummated. So unless there is a way for you to to be together after the the wedding to consummate it you are out of luck. Read the instructions for the I 130 about who may NOT use the form. Filing from a proxy where you didn't consummate the marriage would be throwing money away

This will not be over quickly. You will not enjoy this.

Thanks. Tim has already been through the forms so we knew that but what annoys me is that when I rang the embassy,I explained our circumstances in minute detail. Including the proxy marriage and was told the above! :angry:
