here is a dumb question that i have read the awnser to before but cant find it. My wife is here on a k-1 visa, we recently sent out her AOS packet. So what do we call this limbo status that she is in now while waiting for the AOS???? And if she was ever approached by some kind of person with athority and asked for her ID, her visa is expired now as is her I-94. what would she or I tell them?

Her visa was canceled the day she entered the United States. The stamp on her I-94 provided her lawful presence for 90 days.

She is granted a "period of authorized stay" by the Attorney General while her AOS petition is pending. Keep a copy of the I-485 receipt notice with her passport. This is proof of that period of authorized stay. It also provides the case number that an immigration official can use to verify her status.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

From the VJ FAQ section:

6.11.7)..OK, so my K-1 wife will file I485 for AOS.....Question is, what will her immigration status be from the date she files the AOS paperwork until the interview where she receives (conditional)green card?

A..She is official under a "period of stay authorized by the Attorney General". (FAQ Note: This is due to being an Adjustment Applicant who is awaiting a decision regarding an adjustment of status application)

As JimVaPhuong stated, have your wife carry a photocopy (xerox)of the I-797c that shows her I-485 was received.

3/23/14 - N400 package sent to Phoenix

3/27/14 - N400 package delivered

4/3/14 - NOA1 receipt date

4/4/14 - check cashed

04/29/14 - biometrics date

07/01/14 - interview date

xx/xx/xx - Oath Ceremony
