Ok so I've kinda asked this before with no results, gonna put it out here one last time...

I had my interview in Montreal on the 4th of August. While I wasn't denied, the CO asked for 3 specific things that I needed to show further evidence of and that once I gathered said evidence up, I could send it, along with my passport back to the consulate, etc, etc.

I have gotten everything he asked for EXCEPT this one last, elusive thing. And it seems to be the most difficult thing for me TO get.

He wants me to provide either a) my 1-551 (green card) that was issued in 2001 OR b)proof of surrender of said card (I-407)

Of course, I have searched high and low for this damn card and guess what...I can't find it.

So I call USCIS, speak to a supervisor and explain my predicament, asking which form I can fill out to report that my old card is missing but that I don't want (or need) a replacement, because of course, I no longer have status in the US as a perm. resident. And the supervisor tells me there IS NO form to do that. The only form they have is for lost/stolen cards that need replacing.

Then I go to the airport, ask to speak to the port master of CPB to find out if I can file an I-407 (surrender of my green card) without having an actual card. Of course, he looks at me kinda funny and says, "Well, how can I file this form without an actual card TO surrender" No dice.

I email Montreal, explain that I have torn the house apart looking for the card, that I am willing and eager to swear out an affidavit in front of a judge, saying I do not have the card, I do not know where the card is and to the best of my knowledge, the last time I saw the card was in 2002 and that it is lost (or something to that effect). I also say that I don't remember ever filling in an I-407, that I am not able to do so now because I don't have the card. And even after all that - saying that I think the card is lost, that I can't file an I-407 now and that I will swear out an affidavit, Montreal emails me back with "We are looking for evidence of the applicant’s status in the US when you lived there, you claimed to hold a green card, if you still have it please send it to us, if you surrendered it we require your copy of the I-407 form. You may of course send in any document you wish for review."

Sooooo I'm really REALLY stuck here. This is the LAST thing I need to get my visa approved.

Any suggestions? Anyone?

IDK the answer but seems reasonable if you do an simple, to the point affidavit (NO rambling: lost card and cannot locate, no longer have status as permanent resident) and fill out the lost card form even though you do not want it issued (they wouldnt anyway if you dont have status right? but send in affidavit with that form as well, saying you dont want reissue, you are just notifying the card is lost).

now, i would NOT say you lost in 2002 and never contacted them :blink: just saying you lost it is not goign to be a good thing, but never reporting it is definitely not good. simple and to the point, notify them you have lost it (you do not "think" you lost it, you cant find it, correct? then it's lost, whether it be on the street or in your house).

hopefully someone will post who KNOWS 100% what to do on this but this was my best guess as to what i would do.

if you gave your info (receipt #s, full name, etc) to anyone on VJ under the guise that they would "help" you through the immigration journey with his inside contacts (like his sister at USCIS) ... please contact OLUInquiries@dhs.gov, and go to http://www.whitehouse.gov/contact to report anything suspicious. Contact your congressman and senator's offices as well.

Sounds to me from their reply like they don't so much want the greencard, they want evidence that you had one while living in the USA

Do you have anything from back then? Your old A#, "welcome to the USA" letter, other official paperwork? Anyone9old employer, DMV etc) that may have taken a copy of your greencard or at least written down the details?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

@nab - thanks for the advice, I appreciate it!

@Penguin - thing is, I have provided my old A# on various forms, question 35 on the DS 230, 2nd part of the DS-230 where it asks if I've ever had a S.S. number before (I answered yes and provided the number), I even provided a copy of my immigration court hearing doc that clearly has my A number listed at the top (which was put there BY the court) when I got my perm. resident status taken away.
