Processing Time for Returned Petition

Hello everyone,

My petition has been returned by the embassy to USCIS 3 months ago. When I called them for the status update, I was told to wait 100 days for the case to be reviewed. After 100 days, I called them again. Now they tell me that minimum wait time is actually 120 days (4 months). What if next time they'll give me another time frame? It's been almost 2 years since I started the fiance petition process. I'm so upset :crying: :crying: :crying:

I'm tracking the status online and they say there "We'll let you know once the case is reviewed." Basically, there's no time frame at all!

Has anybody been through this? What's the average wait time?

Sorry mate! Well during mine it took like 6 months!Actually,I do not know when the embassy sent it to USCIS,but I was denied on the 7th of January and I got a reply in first week of August.It was eventually dismissed.Hope yours will be be faster and won't be dismissed.Take care.

We had the same issue with our I-129F petition In February 2009, when it was returned to USCIS the very next day after my interview 'for further review and possible revocation'. We filed a FOIA request for the dinial reason after that, for which we just got "no records on your case' respond 8 months later. Having understood that it was going nowhere, we got married in Ukraine in July 2009 and filed I-130 for CR1 visa in November, and sure we did make a reference to the previous petition in our new one! So, to cut a long story short, we never received a notice of revocation on our I-129F, as well as no NOID with I-130 (thank God!), insted one week before the I-130 approval at CSC, we got a notice of closure for our first petition due to the... term expiration! The letter was dated April 2010 (one year after USCIS received the returned petition!), and as you see, no actions had need made on it. On USCIS website our oficially closed I-129F is still "received and waiting to be reviewed". P.S. According to the site updated, the VSC received our returned I-129F exactly on its expiration date (2009 March 17th)!

With K1 visa it is normal to get a notice that it has expired and you can refile. I didn't wait for the notice , just refiled, which caused them to review the first petition and move the second forward. You do not need to withdraw the first one, just state that you assume it has expired in the second one.

This will not be over quickly. You will not enjoy this.

When we filed our I-130, we did not know what was going on with the I-129F, and we just made a refference to it in our new petition. We did not realize it could expire because we had called the USCIS hotline before and got ensured that they automatically extend it! Our new petition went to CSC while the old one was still with VSC. I think after our call about the new petition being "outside the normal processing time', they did eventually bother to take a look at the old one, and only then closed it (though the closure letter was dated a month before that). We are just happy to have our NOA2 for the I-130 and to be with NVC now after all that disappointment with the K1 visa! P.S. The closing letter had a CO's reason for returning the I-129F: in his honorable opinion the petition 'was filed solely for the immigration purpose'. So, we finally got that reason! For now we just do not know what to expect at the Interview stage with the CR1...
