Waiting on I-130 Rejection

Hi all,

I just want some opinions on the following case. I sent both my I-130 and I-485 separate to the same P.O. Box. My I-485 was rejected last week and after reading our I-797C about a hundred times we resolved that we would send it out again with I-130 NOA when it arrived.

We sent both our packages on July 27th and they were received on July 29th.

I keep waiting and I'm still checking the money order daily just to keep listening to the recorded message telling me the money order is still out standing.

Today I took my extra copy of the I-130 just to check if we had made any mistakes while filing it out and it turns out that we didn't write my I-94 number. :bonk: Now I'm thinking that the I-130 will be rejected too. :crying:

Any advice? Anyone can give us some hope? I'm totally frustrated and upset cause we spent weeks putting all of this together and now it seems that it's all wrong. Anyway, insights are appreciated. :(

IMO,if you sent a copy of your I-94 with your I-130 ,then it wouldn't result in a denial(I could be wrong).You might receive an RFE for that,not sure you will.I think,you'd be fine.Good luck !!

Well, your case is kinda tricky, you filed seperately but on the same day, to the same P.O BOX but they can really be strict if you don't file it concurrently (i.e you have to have one big envelope and inside are two big envelopes (for I-130 and I-485).

Your I-485 has already been rejected and now, they ONLY have your I-130, if they process it, your whole AOS application might get rejected even if they didn't reject your I-130. (Reason being that you didn't file concurrently)

I really hope, when you receive your NOA receipt for I-130 and when you send it together with your I-485, it won't be a problem. (To tell you the truth, technically, it kinda is a problem since they will still receive the I-485 seperately from your I-130).

So, in this case, it might be best if they didn't cash in all your checks and return you back the 1-130 as well, so you could file BOTH concurrently in the same big envelope.

(DAY 123)23 August 2010 - Green Card Received.

[ Petition to Remove Condition on Residence - Took 8 Months ]

11 July 2012 - Package Sent to Vermont Service Center

16 July 2012 - NOA received

26 July 2012 - Received Biometric appointment letter scheduled on 10 August 2012

10 August 2012 - Did Biometrics appointment

08 March 2013 - Received APPROVAL letter (YAY!!!)

09 March 2010 - Received 10 year Green Card!!!!

Thank you Bl@ckrose we're both hoping they do send it back... but now I am really worrying, and it doesn't help that nothing has happened yet either. But oh well... nothing I can do about it now.

Anyone has any more insights? :)

I am so sorry that you have to go through this. (F) Unfortuntely I don't know much about this kind of cases, so I can't really give you a good advice. However, have you tried to schedule an infopass to the local office in Fairfax to explain the situation?
