Hello all,

We are finishing up our AOS paperwork in the next few days, as my husband's visa will officially expire in the next few weeks. We have obviously fulfilled the marriage requirements of the visa, but I'm concerned about our I-864 forms. I will be the sole sponsor for him, and though I make 125% above the poverty line this year and in 2008, I did not last year. My question is this: If I am rejected as his sponsor, will this cancel out/stall our AOS request entirely, now making my husband illegal in the country with an expired visa? Or do they just accept the application and allow me to find a joint sponsor within a certain time frame? Has anyone had any experience with a situation like this?

Thanks a lot for any advice/info.
