Tax Transcript

Hi All,

I'm confused and hoping that someone can help me out. Hubby and I filed AOS about a month and a half ago, but didn't include the the Affidavit of Support cuz our 2009 taxes were not done yet and his 2008 had not been filed either. We filed both last week, but now I'm not sure about what to do for the Affidavit of Support. It says that you have to show the tax transcript from years that were filed late, but it will take up to 8 weeks for it to show up in the records at the IRS(so they say). Do I need to wait until I have the 2008 transcript in my hands or can I send the form and 2009 taxes without it. I have already received the RFE for the Affidavit of Support and it says to send all documents at the same time. Does anyone have experience with this? I want to do this as soon as possible.

does your 2009 income meets poverty guidelines? if it does, 2009 would be enough , 2008 and 2007 are optional

Yes. It meets the guideline. I thought you have to prove that 2008 has been filed if it is late, since you should have filed for all 3 years.

I imagine your evidence needs to be received by USCIS sooner than 8 weeks from now. Send them the I864 with ALL the pages from 2009, if they want more, they'll ask for it.

All they ask for is the prior tax year, with 3 prior years being optional.
