Dear all,

If anyone out there is able to help it would be much appreciated.

My fiance did not work last year - she was in the UK with me for the majority of it. Therefore under US law she does not have to file taxes for 2009 as she didnt make the minimum requirement to file, nor was she able to work in the UK. Therefore we phoned the IRS and they said dont file and thats it, they would not write a letter to say this. I dont know why - too busy i suppose. However, my fiance does use a lady to file her taxes and has written a letter explaining the situation. She has a good job now - in fact she just got a raise - however, we have got a co-sponsor just incase as her 2009 income is nil.

My question is would the letter from her accountant/'tax lady' be enough? Would they deny us because she didnt file but she didnt have to file???

Its all a little too late now given my interview is looming but i wanted to ask just incase we needed more information - but what more information can we get!!!

No, they shouldn't deny you because of that, but it would be a good idea for your fiance to write and sign a note explaining why they did not file an income tax for 2009 and why they were not legally required to.

July 25, 2013 - 10 year green card APPROVED!! (notification via text and email, and website updated)

July 29, 2013 - ROC approval letter received in the mail

July 31, 2013 - 10 year green card received in the mail!!!

March 24, 2014 - NOA1 date and Priority Date

Thank you Christi85, So then we will have two letters explaining the situation - one from her and one from the professional. Better to be safe than sorry. Thank you so much for your comments it has gone along way to putting my mind at rest!!!

The IRS doesn't provide any letters stating that someone isn't required to file a return because they have no way of knowing for sure if it's true. The taxpayer could have had income the IRS wasn't aware of.

Anyway, a statement from the sponsor explaining why they were not required to file a return is all that most consulates require. London isn't known to be particularly strict about the affidavit of support. If you can show sufficient current income then that should be enough. It might be prudent to line up a co-sponsor, just in case.
