Hi to anyone who can help!

I am a British and living in England with my American husband! He has to go back to the US shorty, I want to file my K3 visa so I can go and live there with him asap! I am not sure whether it makes any difference that we got married in the US and now I am filing my K3 application in England. And my next question is that while the application is processing can I travel to the US on a waver visa? Oh and the cheapest way of doing it!?

I would appreciate any advice

K-3 visa is effectively dead

Has yer husband lived in UK as a resident for 6 months or more? If so, he qualifies to file an I-130 to the Embassy in London via the Direct Consular Filing Process ( see http://www.visajourney.com/content/dcf )

If he needs to file the I-130 in the USA - this guide is useful - http://www.visajourney.com/content/i130guide1 and disregard all info to 'file an I-129F' - as the K-3 is effectively closed, with the I-129F being administratively closed at NVC, should it travel together with the approved I-130 petition.

But hei - don't sweat - it's all just paperwork .

re: coming to the USA for a visit - sure - it's possible, you have to show strong ties to the UK, to the POE / CBP folks on entering, when entering with the Visa Waiver Program.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
