Last 3 years of US tax returns?

Hi,

I just recently sent off my I-130 paperwork to bring my canadian hubby to the usa. I was just looking through the requirements of documents needed in the future and have a question about the last 3 years of US tax returns/W-2's. I was employed solely in Canada, while going to school from 2006-2009, will it suffice to bring my last 3 years of canadian tax returns? I wasn't making very much money because I was a student, but I think now, working in the US I am above the poverty threshold. Thanks for your advice!

I hope you realize that even if you were working abroad... as a USC, you still have an obligation to file an annual US tax return.... Your worldwide income is potentially taxable by the US government....

Even if I was a full-time resident of Canada and made zero dollars in the US? If that's the case I guess I need to go see the taxman.

No Jenny first off you will only need last years income tax return, even though you are in another country that doesnt exempt you from filing a US tax return.

And foreign earned income will not be sufficient for the purpose of an I-864, because the employment has to be ongoing when he is admitted into the US and you being his primary sponsor cannot live in Canada and he live in the US

Bottom line is you are going to need a co-sponsor that can prove 125% for thier household including your husband

OK after re-reading your post I see your working in the US now, still you will need one year tax return and an employment letter from your current employer along with pay stubs -

Thanks. I guess I need to go back the next 3 years and file. I make far above the 125% mark and will get a letter from my employer stating annual pay, I am assuming this will be good enough and I will not need a sponsor, right? Thanks

Yup, it sucks to be a USC... the IRS has the authority to go after and try to tax our "worldwide" income....
