A person work in usa in non-immigrant visa but just in cash so there is no record for this.

after few time he go back to his country then go usa again in fiance visa. in application question " have you violate the terms of us visa? he put NO because although he work before in cash but there is no record.

What happen if someone complain in immigraion that he work before?

what he should tell that yes he work but it is not "material fact" thats why he didnt mention

or he should refuse it and say that no he didnt work at all.
