Due to finacial isssues, we are now applying for AOS after 14 months of getting married I know it's a dumb thing to due. but we are worried there is going to be a problem as we are so late applying. I got married within the 90 days on the K1. Question is, as were applying for the AOS 16 months after we married, is this going to cause a major issue? My I-94 date ran out 18 April 2009.

Thanks

My husband and I also waited to file his AOS til late, also due to financial reasons. We didn't have a problem, only thing is you'll probably need a whole new medical, as the one for the K-1 was valid for 1 year.

I got married in July '09, and sent everything in to the USCIS in October '09. I ended up getting an RFE, and by the time things were sent back in to the USCIS by my attorney's it was November. My I-94 expired in October '09 , and other than feeling that my AOS application is taking forever (its been 5 months now since my case was transferred to CSC). My notices were on time (until now), I went for my biometrics, and my EAD, AP, and SSN were issued to me. My time line for filing for AOS wasn't as long as yours, but I wouldnt think that it would be a problem. Best of luck to you.
