Hello all

I am in the process of obtaining a K1 (fiancee) visa and have my medical scheduled for early in July, after which I will request the interview at the US embassy in London.

In the meantime, my company would like to transfer me to our US subsidiary (where I have worked previously) and will be arranging for me to apply for either an e-visa or an L1 (which I had before).

My question is:-

If I apply for an e-visa (or L1), will this allow me into and back out of the US even after my K1 is (hopefully!) issued? This would allow me to continue travelling for my job, whilst planning my wedding. i.e. would I be allowed to travel using an e-visa even after a K1 has been issued (which I realise has to be ‘activated’ within 6 months of issuance)?

You cannot hold two visas at one time, so I would think once you get the K1, your L1will no longer apply. It may be difficult to get the L1 with a K1 pending anyway, as they will presume immigrant intent. Your best bet may be to try and speed up the K1 as much as possible.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

You cannot hold two visas at one time, so I would think once you get the K1, your L1will no longer apply. It may be difficult to get the L1 with a K1 pending anyway, as they will presume immigrant intent. Your best bet may be to try and speed up the K1 as much as possible.

Problem is though - even if you can speed up the K-1, you can't work on it once you enter the US until after you go through AOS & get your EAD or green card.

Not entirely sure if I'm correct, but if an E or L visa is one that you can adjust your status from and your work is sponsoring you wouldn't it be better to go with one of those, marry and AOS than to go the K1 route? As it was mentioned above, you can't work until you do AOS / EAD from a K1 anyway. I think that you can find out which visas you can AOS from on the Department of State website.
