Hi, I have a question, First I want to say that I have a co-sponsor which is my sister but the situations is that on the past year I did not work at all because I was pregnant and was a full time graduate student. So therefore, I do not have any income my fiance can show when he goes to the interview just my sister AOS.... So my question is that with this issue will it be difficult for us to get approved???? My sister made 46,000 this past year.... i am not sure if that would be enough, plus he has 2 sons and she add my daughter and I in her income tax??? I appreciate your advice!!

Here is a link on the poverty guidelines (please use caution because those are the 2009 guideline and they could change any time)

so according to that and taking 125% of the number it looks like $46,000 is enough for 7 people. So if you add yourself and all your dependents your fiancé and all his dependents and your sister and all her dependents and it's less than 7 person you're fine. If it's more than 7 people then you'll have to see if the assets of your sister can help.

Also I wanted to add your fiancé CAN NOT go to the interview with only your sister AOS. He'll need one filled by you as well, even if you put $0 on every line of the form you are and will remain the primary sponsor.

Well then you count yourself has a dependent of your sister among all the other dependents.

Well then you count yourself has a dependent of your sister among all the other dependents.

Even if you didn't fill a tax return you MUST fill an affidavit of support (when the time comes) on Your name as YOU will be the primary sponsor in the eyes of USCIS.
