So I am about to send everything to my honey and she points out that I-134 is expired but it doesn't seem that there is a replacement out there. I don't think I should worry but I always worry so here i am.

on a side note the Malaysian embassy sent her a form DS-1858 that i am supposed to sign and send back?? it doesn't look like there is anywhere to download it on the internet and it really seems to just duplicate what is on the I-134.

any thoughts??

Well, you should care, but you do not need to worry. Since there is no more recent form posted at USCIS web site, and they still say the current version is 10/30/2008, you cannot do anything. So you do not need to worry about a 221(g) at the Embassy/Consulate.

10/30/2008. Prior versions are also acceptable.

Good luck.

It will not let me add or edit to my previous post.

Sorry, I just read about the DS-1858 in your post. If that is what the Malaysian Embassy/Consulate requests for meeting the terms of the DoS OF-167 (DoS requirements to keep the Alien Beneficiary from becoming a Public Charge), then you should use the DS-1858.

thanks for your replies

it seems odd to me that tehre is no downloadable form on the interweb... I have only managed to find a couple of scanned copies and they don't look so good. I will be e-mailing the embassy on Monday just to confirm that they still need this form. Sadly there is a perfect copy sitting in my honey's apartment that I suppose I could have her send to me.

Thanks for the information. I was wondering if they really needed the DS-1858.

Good luck.
