Please tell me that this is no joke...

On June 3, 2010, we mailed you a notice that we have approved this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.

For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

And here I thought it was going to take 7-10 years!! OMG...I'm flabergasted!!

And here I thought it was going to take 7-10 years!! OMG...I'm flabergasted!!

Whoa. Wait a sec. Is the step-dad a USC? How old is the step-brother? Getting the petition approved is only the first step, and it's usually completed relatively quickly. If the visa is subject to a quota, then it may sit at NVC for years before the priority date becomes current and a visa is available.

Jim's right...the NVC waits for DOS to issue the number to continue processing...you can check out the current visa bulletin times on the DOS website; they are updated monthly. This is where you'll be doing all the waiting...

Taking a quick look at the June bulletin,

If the step-dad is a USC and the son is not married, then DOS is issuing numbers from petitions before November 2004.

If the step-dad is a permanent resident and the child is under 21, then DOS is issuing numbers from before January 2008

If the step-dad is a permament resident and the child is over 21 and unmarried, then DOS is issuing numbers from before November 2002

If the step-dad is a USC and the son is married, then DOS is issuing numbers from before June 2001.

My stepdad is a USC. His son is over 21 and married with family.

My stepdad currently has two active petitions for two sons over 21 and married. The 1st petition is still at the USCIS stage waiting for DNA testing that I had inquiries about in other threads. The testing is still pending in VN but he (stepbro) should be going sometime this month. That petition was submitted in December 2008 and processed at the Vermont Service Center.

The 2nd petition was filed in April 2010 and was forwarded to the California Service Center. The USCIS website stated that it would be a minimum of 7 years before it would even be reviewed (yes USCIS, not DOS), but to my surprise, it was approved within 2 months!!

I understand that there is a longer wait, but I guess I had the expectation that it would take longer at the USCIS stage...so this is quite a pleasant surprise! :)

Where did you see this on the USCIS website? As far as I know, they're not supposed to be sitting on petitions waiting for anything, unless they haven't made it up the queue for adjudication, or they've sent an RFE for additional evidence. Also, managing the quota system and issuing visas is the job of the Department of State, so USCIS doesn't really have anything to say about how long it will take to get a visa. They only control how long it will take to get a petition approved and forwarded to DoS.

From the latest visa bulletin, it looks like about a 9 year wait for a married child of a US citizen.

I cant seem to find it anymore, but I recall it very clearly...it was a table with colored rows and each row had the type of petition in one column, preference in another column, columns for the different service centers with the date that petitions were being reviewed...I remember looking at that table/schedule because for the longest time, I wished that my husband's petition was sent to California because around September 08 they were reviewing petitions from June 08 and then in December 08, I received notice that my petition was forwarded to the California service center for processing. When my stepdad filed for his first son in Dec 08, I was praying that it went to the Vermont Service Center because they were processing those petitions more quickly (4 years as opposed to 8) than the California Service Center.

I may have saved it, but I'm not going to waste my time looking for it again since it doesn't have any further impact on the petitions. :) I'm just happy one of the petitions have been approved (not the visa being approved)! :)

Maybe if I'm bored one day I'll try to see if they still have that schedule up, highly doubt it since they have the fancy new online processing time info/check your status online... :P

Actually, it wasn't a column...you had to select the service center first and then it took you to the next page which provided the 3 different columns Petition type, Preference, Currently Processing Applications that were submitted on X date.

And as of March 31st, the California Service Center still says the processing time frame is June 09, 2002...

(this is why I am quite shocked that it (the petition, not the visa) was approved in two months...) :):D
