My fiancee is from the Philippines, her interview was may 21 2010, they asked for w2 and income tax , i am disabled and receive social security disability payments so therefore i do not file income tax and do not receive a w2, what should i do? i sent them a 1099 showing them what i receive from social security. but they still want to know why i don't file. what should i do?

The CO's are not tax professionals and likely do not understand. As well, we do not know the specifics and if you might receive, interest, dividends or any other forms of benefits that could bump you into the "required to file" range.

You may want to consult with a tax professional and have them review all your facts. Maybe they could draft a letter that explains it and you can send it as proof.

I really don't know about this so I'm grasping at straws.

If your only source of income is non-taxable then you need to write them a letter explaining that is the reason you aren't required to file a tax return.

Hi Nate96,

I'm new here but your situation was very similar to mine with the disability/no w-2/Filipina Fiancee. I had given them my SS-1099 as my only proof/source of income. My Fiancee's interview was on May 17, 2010 and it seemed kind of strange compared to others I had read about. The whole interview lasted about 2 minutes and the only documents from the application he kept were my SS-1099 and my bank statements. He wrote or checked on the form he gave to my back to my Fiancee "Please wait to hear from us." And then something about administrative processing/review. He said nothing about approval or denial. So, of course, we immediately started thinking the worst. He did keep her passport and had her pay the Air21 fee but never told her why. Obviously we were pretty bummed the next week and driving ourselves crazy trying to figure out what went wrong. She thought she had done something wrong and I just knew I was going to be be in an IRS Audit in a few weeks...LOL! Long story short...she received a text Monday night (Phil time) from Air21 and received a package about 12:00 noon Tuesday WITH HER VISA!!! So, My question would be... Did they keep her passport and have her pay the Air21 fee. If they did, you are probably ok and should hear from them soon. If they didn't....I don't know but keep us posted.

PS: Jackie arrives June 8, 2010. Best flights I found were on Cheapoair.com . $1,087 one way.
