Petitioner not the Sponsor for Affidavit of Support

Hello!

I'm am filling all the forms the Green Card right now.

And I am having problems with the Affidavit of Support.

My boyfriend (will get married this week) didn't fill his tax returns the last 3 years.

So I would like to know if someone else can fill the I-864 or if he needs to fill it anyway even if someone else is filling it too?

Don't know if I'm clear enough for everyone to understand what I mean...

Yes, the petitioner is always the primary sponsor and submits an affidavit of support regardless of income level.

Do some reading in the Instructions for the I-864 and you will see the following on page 8:

If you were required to file a Federal income tax return duringany of the previous three tax years but did not do so, you must file any and all late returns with IRS and attach an IRS-generated tax return transcript documenting your late filing before submitting the I-864 Affidavit of Support. If you were not required to file a Federal income tax return under U.S. tax law because your income was too low, attach a written explanation. If you were not required to file a Federal income tax return under U.S. tax law for any other reason, attach a written explanation including evidence of the exemption andhow you are subject to it...
