Hello everyone.

I am starting the K1 process and have some questions. From what I understand I need to complete the I-129F and submit along with a G-325 for both me and my fiance, my birth certificate and/or passport, a passport photo for both of us, and a letter of intent to marry from both of us once he is in the United States. Is there anything besides this that is required to be sent at the time of the I-129?

Also, my fiance is an Egyptian citizen, but working in Saudi Arabia, does he have to go for the interview in Egypt or can he complete it in KSA? And I know its not required, but would it help when I send the I-129F to also include records of our relationship, and photos of or meeting, or is it best to wait until they request it?

Don't forget to include proof of meeting within the past two years, such as boarding passes, passport stamps, receipts and photos.

If you use the checklist in the guide section you'll cover what is needed.

You can provide more than what is required, we provided additional photos, receipts and boarding passes, etc from all visits we had prior to the filing of the petition (also referred to as "front-loading".

Not sure about your question about interview location.

I have a question too about starting the K-1 process. I am a recent divorcee. My home state (Wisconsin) in which the marriage and divorce occurred. In this state, remarriage cannot occur until 6 months after the divorce is granted. So, my question is, can I start the K-1 process before the waiting period is over knowing that the K-1 process will take time and given the 3 month window after the fiance arrives in the US?

Yes, for the i-129 you have covered it all but since you fiance is Egyptian citizen, he has to to go to Cairo for an interview when the time comes. An yes, it is extremely helpful to your case if you include records of your relationship, photos (definitely) and proof of having been together within the last two years... And yes, you need to wait unitlyou are legally able to marry. Good luck!

To original OP:

Do not forget the $455. That is what the USCIS checks for first. LOL

Also, if either of you have previously married, then you will need to supply a copy of the certified Divorce Decree.

I know you can request a Consulate/Embassy for your interview if you live outside the country of your nationality, there is a place on the I-129F form that asks what Embassy/Consulate you want to interview. I do not know if there is something special about Egyptians that would prevent them from interviewing at Riyadh, Saudi Arabia. It is allowed and many people interview at Embassies or COnsulates outside their native country.

Also to the recently divorced person, yes you must wait because you must be eligible to marry at the time you SUBMIT the I-129F, not eligible to marry at some later time in the process. So please wait.

Sammy, I am in WI too and am in the same situation. It is my understanding that you can not file. One of the criteria for filing is that you are "able" to be married. Unfortunately you are not "able" to be married for 6 mo after the divorce is finalized here in WI.

Thanks. I was afraid of that. Now that our timeline has been thrown off as we were planning the marriage party back in Thailand sometime shortly after we recieved the "parole" to leave the US during the AOS stage, would it better to now do both the ceremony and party there at that same time and proceed through the K-3 route or just bide the time and stay with the K-1 plan?

The K-3 process was obsoleted in February 2010 (I believe it was February). You need to look at the CR-1 process and filing I-130.
