Hello, and thank you in advance for any and all help,

My fiance' and her 3 children (twin 16 yr old girls and a 3 yr old son) came via a K-1 Visa . We were married on the 90th day after their arrival 08/24/08. Due to life making its plans while laughing at ours, I'm just now able to apply for their AOS. I'm hoping that the 2 yr delay isn't a issue..

I have a few questions I haven't been able to find through the searching of the forums. I'm sure there I'm just not looking correctly.

Is my wife the applicant for AOS and the children come under her application, or do I need to file separate applications (packages & checks) for each of the children as well?

I-485 – Do I need a I-485 for "each" person? Then when mailing separate checks for each person since the filing fees are different 'cause of the ages?

G-325A – Do I need a G-325A for "each" person as well?

I-864 – Who is the petitioner? If it is her, do I need to be the co-sponsor since she hasn't a income? Or am I the petitioner for her & the children and file separate I-864 for each of them?

I-131 – Do the kids travel under her I-131, or do I file for each individually?

Do I send ALL these forms & applications in ONE package or does the I-131 for example get mailed separate, w/separate check/s to a separate office?

12-19-'10: AOS Received Biometrics Letter

12-27-'10: AOS Walked In Biometrics For Both 495 & EAD

01-06-'11: AOS Biometrics Appointment

01-11-'11: EAD Biometrics Appointment

02-11-'11: EAD Notification : On February 11, 2011

03-29-'11: AOS Notification : On March 29, 2011, mailed appointment notice for interview for May 4, 2011

I don't know all the answers, but you are the petitioner and you must file for each of them separatly. If you don't have enough to be sponsor you must find a joint sponsor. I adjustment packet for each of them. I'm not sure if they are allowed to travel, since they are out of status now.

Separate applications but can combine all costs onto one check (that's what we did).

I-485 – Do I need a I-485 for "each" person? Then when mailing separate checks for each person since the filing fees are different 'cause of the ages?

Separate, one for each.

G-325A – Do I need a G-325A for "each" person as well?

Yes.

I-864 – Who is the petitioner? If it is her, do I need to be the co-sponsor since she hasn't a income? Or am I the petitioner for her & the children and file separate I-864 for each of them?

You are the petitioner. Read the instructions. You can make a copy of the 864 you file for her and do not need to copy the financial info (tax transcripts, pay stubs, employer letter) for their copies.

Separate applications for each. Include two passport photos (besides the two of each for each of the G-325As above) and another copy of the ID page from each passport and copy of the visa page and both sides of teh I-94.

All in one package, include a cover letter with itemized listing of what you are sending and for whom and all sent to the Chicago Lockbox address.
