I-864 - - And getting Layed Off

I am being layed off from my job on Monday May 3rd and was previsouly the sole sponsor for my Finances K-1 Visa. he is now with me in the states and we will be getting married on June 26th 2010 I am not sure if I will have a job by then to show Verification fo Employment for the 1-864 Aff of Support. Will this cause any issues with his application for AOS?

If I get someone to co-sponsor my Aff of Support will that be ok? I will be on unemployment until i can find a job.

Any inputs, or ideas of if i should be stressed?

If you can find a co-sponsor, this will be the least stressful option for your situation.

Else, Try to find a job with sufficient income before you file

Else, the I-864 only requires the latest year's tax-return (or transcript) as proof of income. They can RFE for more proof of current income later - which you may have by then OR, you can submit a co-sponsor at that time. This would be the most stressful way to go about it.

K-1:

January 28, 2009: NOA1

June 4, 2009: Interview - APPROVED!!!

October 11, 2009: Wedding

AOS:

December 23, 2009: NOA1!

January 22, 2010: Bogus RFE corrected through congressional inquiry "EAD waiting on biometrics only" Read about it here.

March 15, 2010: AOS interview - RFE for I-693 vaccination supplement - CS signed part 6!

March 27, 2010: Green Card recieved

ROC:

March 1, 2012: Mailed ROC package

March 7, 2012: Tracking says "notice left"...after a phone call to post office.

Hey

This happened to us... my husband lost his job after I arrived but before filing for AOS, I feel your pain!!!!!

We luckily could ask his Aunt to co-sponsor me, so we filed an I-864 for him (Stating current income $0.00 - but including previous years tax returns) and one for his Aunt. As long as that person is over the poverty levels after dependants etc you'll be fine..

We just had our greencard interview, and it wasnt even mentioned - we have been approved, so it hasnt effected our application in the slightest!!

Hope this eases some angst! As if being made redundant isnt stressful enough!!!!!
