Salam all

hope all doing great

well my question is

in next NOV. my marriage will be 2 years and am delaying my papers in NVC on purpose

so i would ask if i make the interview before NOV. or after and the visa issue as CR1 is anyway to get it back to them so they can fix it to IR1 or i can change it in JFK airport ?

so i need yr advise guys to know what to do to be IR1 not CR1 because i dont wana to deal anymore with USCIS?

Regardless of the interview date, you are entitled to the IR1 status if your first entry (after obtaining the CR1 or IR1 visa) after the two year anniversary. You'll want to be sure to mention the passing of the anniversary and IR1 status at the POE, just in case. If they make a mistake, it can be corrected after the fact too.

Regardless of the interview date, you are entitled to the IR1 status if your first entry (after obtaining the CR1 or IR1 visa) after the two year anniversary. You'll want to be sure to mention the passing of the anniversary and IR1 status at the POE, just in case. If they make a mistake, it can be corrected after the fact too.

Adding to this, this case is quite similar to mine. We filed a k3/got approved and intentionally delayed the processing of the 130 ( held it there for over a year because we did not want to have to lift CR status in two years, pay more fee, etc. ). My wife and I will attend the IR1 interview this coming Monday so upon next POE she could qualify for the ten year greencard.

Fortunately, on all the notifications from NVC, it states clearly that my wife's case is an IR1.

To answer the original question, PSHBRK is correct about one's right to obtain the IR1 status after two years even in the event of an error by POE officer, oversight, etc.. But it just makes life that much easier if the IR1 visa intent is stated on your case and case number from the beginning.

You could email/not call the NVC to notify them of this intent, or you could attend the consulate interview to help clarify.

I have heard of horror stories of officers at POE doing crazy things like taking away people's passport and creating problems that could otherwise been prevented. Relying on POE officer to make the correction ought to be a last resort because if they don't, you may have to make an infopass appt to request correction.

Actually, you said you were together interviewing for an IR1. You didn't say visa. Of course what you are doing is appropriate for your circumstance but IR1 is both a visa and a status. I didn't make assumptions about which you were doing. I asked you for clarification.

Mistakes are sometimes made but CR1 visa holders who enter the US after their second anniversary routinely receive ten year green cards with IR1 noted as the status. No amount of intent to enter after the anniversary will result in an IR1 visa if the visa is issued BEFORE the two year anniversary. I advised the OP to mention the anniversary date at the POE, just in case.

Not sure what your beef is but there was nothing inaccurate or incomplete about my advise to the OP or in my post to you. Dates, not intent, rule the day for which visa is issued and which status the visa holder is entitled to upon entry.

My family's intent for AOS (after K3/4 entry) was to have the interview after the two-year anniversary and we filed at the last possible time before the July 2007 fee increases went into effect. Had our interview been scheduled before the two-year anniversary 95 days after filing, my wife and daughter would have two year CR1 green cards regardless of our intent. As it worked out the interview was 50 days after the anniversary, so IR1/2 status.

Strangely, my wife's card indicated she was from Taiwan instead of PRC China, even though the daughter's was correct. It was replaced within a month with the corrected card.

Correct. The date is most important. But the fastest/easiest way to get the correct IR visa/status is to request ahead of time.

This will avoid having to wait for further corrections, replacement of greencards, or the need to make appointments for correction.

My beef here is that if you want the IR visa or IR status, one ought to make the request or make it known to NVC or embassy consulate asap.

Not after POE and not later through infopass appointments. The beef is in getting the IR status and visa prior to POE.

Anything else is possible but it takes time.

The easiest way is to do the interview after the two year mark. If you do it before the two year mark, you will be issued a CR visa/status and you will have to lift CR status which could cost money.

Pushbrk has explained well about the importance of the date of POE and I must disagree for the very reason you have asked. If you do the interview before the two year mark and you happen to enter POE after the two year mark, you will have to do some explaining to get the IR status. If things flow well you could be switched to IR status but if it doesn't you may have to adjust status from CR to IR which may cost money.
