Hi VJ friends,

I just landed in VN to enjoy my and my fiance's birthdays. It will probably be a six week visit.

Aside from the usual record keeping of our activities, is there any thing worthwhile that I should proactively do at the Consulate office? (My K1 case through attorney representation is currently being rebutted and reviewed at USCIS CSC.)

I.E, should I visit the Consulate to affirm/notarize an affidavit of relationship and intent to marry?

Thanks,

If your case is in a rebuttal, then there is nothing you can really do while in Vietnam accept go and have coffee with Binh and me no0pb.gif Seriously though while there is no actual case in HCMC there is nothing you can do there, if you were planning on refiling you could get something done like you sugested about an affadavit of intent to marry, it really would not do anything accept be proof of another trip. This would help in a new application, and it would help if your case gets re affirmed. Good luck on the rebuttal, and if you do want to go have coffee or tea, hit us up, just pm me and we will work out the details. Jerome

I agree with Jerome 100%. The consulate doesn't have any case pending for you, so there isn't anything you could do there.

You've sent a rebuttal to USCIS for the NOID. At this point, I'm not sure there's much else you can do. This business with CSC sending NOID's for the second petition citing the CO's denial of the first visa is something new. You're essentially arguing against a petition which USCIS has already said is dead in order to try to keep another petition alive. A lot of people, including myself, are watching these cases to see what happens.

Also, you should update your timeline. It helps the system to calculate more accurate processing time averages when there are more completed processes in the database, and many people use those numbers to get an idea what to expect. Also, change your selected consulate. Seriously, Armenia???
