can i apply for a j1 visa while im processing for cr1

hi everyone

i am egyptian citizen and im married to an american citizen

and we did our papers in the american embassy in cairo for cr1 visa

and i was approved and they sent me the 2nd package for sponsorship and medical examination

and while im finishing my papers i got the opportunity to work in the usa under j1 visa exchange visitors

so my question is

can i apply for a j1 visa while im processing for a cr1 visa?

if that happened and i went to the interview they will deny me?

and if i went to the usa under the j1 visa i can change my statues later and finish the rest of my papers as a cr1

and get my green card without problems or they will ask me to go back to egypt for 2 years first?

please answer me asap

If I were you - I would stick with the CR-1 processing and get that out of the way- it grants you a greencard as soon as you come to the US. (so you can work).

If you do the J-1 (doubtful they would grant it, since you have the CR-1 processing - unknown) - you would suffer under the 2yr rule, and you would have to seek a waiver to get around that (more paperwork, more money).

If they did deny your J-1 - depending on the reason, it may or may not affect your CR-1 processing. (say they find out you did drugs or something, that would deny you on both visas)

So I am back where I started - finish the CR-1.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

but i was thinking about going to the usa under j1 cause it will be fast for me and no sponsor need and when im there i will finish my cr1 or even change it cause i spent more then 2 years marriage now which mean ir1 so that will be possible with me there?

and in the same time do j1 need ties and bank account and such things?

cause if it need all that i may be refused cause im already married to an american woman and that will show that i will never come back maybe

m i right? this may denied me on both j1 and cr1 as amor said...

i think ur right guys cause this will put me in the middle of no where with more money and 400$ fees for forms and then i will be denied cause i have no ties and my wife is american citizen which mean i will never come back home

Timeline

If you do this, you will have to either have the papers transferred to the US (adding cost and LOTS of time) or you'll have to return to your home consulate for the interview, at which time you might be denied because the J1 typically, by virtue of being an EXCHANGE NON-IMMIGRANT visa program (typically) requires you to return home for two years after the j1. . .you would then have to get a waiver for the J1 requirement thus adding AGAIN more time and expense.

In addition, if you've returned to the home consulate to process, you may be barred from even using the J1 while they sort things out.

This is a VERY BAD idea. If you're already filing affidavit of support documents, then you are in the home stretch and really should not risk trying to use/apply for a non-immigrant visa with FULL immigrant intent.

BAD IDEA.
