My fiance (the petitioner) submitted the I-129F packet to the California Service Center last June 7, and although he received the NOA1 in the mail last July 1, It wasn't until last week (while he was reviewing the checklist of the documents that he sent to USCIS) that he realized that he overlooked the G-325A forms. In short, we're lacking that particular form as of this moment.

Now we're not sure as to whether we should just anticipate that he will get a Request for Evidence from USCIS (because of the G-325A forms that he wasn't able to submit along with the application) or should we just send in the G-325A as soon as possible? If so, how is he supposed to label/mark the follow-up forms? Do you think it will cause much delay?

I've tried going through all the information that this site has to offer and though I've learned a lot, there's really no specific answer regarding my concern. To those who may enlighten us, we'd appreciate your help. Thanks a lot!

You can send the forms in. That doesnt mean you still wont get an RFE, but it might forestall that.

Enclose the documents in an envolope with cover letter explaining what it is, ensure your case number is on cover letter!! Also on envolope write

Ref: Case number, Received Date and petitioners name.

I would give that a try. Worse that can happen is that you will get RFE anyway. Best is that they will get it in your package and you will forestall the RFE.

I haven't heard of any 'success stories' where someone's missing paperwork caught up to the petitioner's file.... can't hurt to send it in, but I would be prepared for the RFE which is inevitable.

Personally, I would wait for the RFE. They send you a self-addressed special envelope to use to return the requested documents and that way it gets to the correct department and attached to your file.

We got an RFE because we didn't send in original signed G-325A's. After they received our new G-325A's, we were approved shortly thereafter.

Interesting. I'm mildly surprised that the submission was not returned with a Rejection Notice for being incomplete. Maybe the staff was too harried and focused on the IMBRA issue to have noticed when they sorted the submission and created the file.

I'm with those who think that it's probably best to wait for an RFE before sending the G-325As.
