Birth and Divorce certificates

Our case is currently at NVC. We were expecting to get a case complete this week, but instead got a RFE. The issue seems to be the birth and divorce certificates. The certificates that are from Japan are all on one paper, they are not separated. We sent the original in along with English translations of both the Birth and Divorce.

The NVC sent us a letter stating we need to send the originals in of the Birth and Divorce certificate. We did this! I was told by the NVC operator that the certificates need to be from a certain place (Honseki) and document (Koseki) in Japan so they will be accepted by the NVC. I explained to the operator that I verified through my wife that they are in fact from this place and that everything should be fine. I don't know what they want me to get and I told them this is all I can get. I also worry now about the English translation for these since I may need to get new ones if I need to send these certificates again and they are the same thing according to my wife! We got the original English translations at the Japanese embassy in San Francisco when my wife was visiting here.

Can I use the old certified translations that were already sent to NVC with the first original certificate since they look the same? I worry about the dates and that it may not be acceptable. My wife said there is no place to get English translations of the new certificates that she knows of other then at the US embassy in Tokyo and she lives 2 hours away by plane. Any help with this matter would be appreciated. Maybe other VJ members who have dealt with or are dealing with their spouses in Japan would have more knowledge on this.

RFE for originals but the NVC stated either originals or Certified Copies.

hi pacmtrx7 Q. When they say 'certified copy from the issuing entity' what does that really mean.A. We will use a Birth Certificate as an example.

When someone is born their Mother will fill out a form to register the birth. The Doctor or hospital administrator will fill in other details. The Mother signs the form and submits it to hospital administration.

The form is then sent to the person who registers births in any given country, to be kept on file.

What NVC is asking is for you to go to the Government office, in the country of birth, (for this example) and ask them to give you a certified copy of the birth registry.

Technically the 'certified copy' may be a photocopy - however it is generally government issued and will have a stamp/seal and state that it is a true certified copy of the birth entry.

This is a general answer intended to clarify what NVC is asking for when they make that statement. In all cases you should check the Reprocity by Country page for details on which documents NVC will require for your particular country.

Q. It makes me nervous to send an original, what if they lose it or it gets lost in the mail?

A. There is no good answer to this question. You may want to courier the package to NVC with a tracking number or send it certified mail.

Q. What about translations, my documents are not in English, do I have to have them translated?

A. Technically the answer from the Department of State is:

Translation Requirements

All documents not in English, or in the official language of the country in which application for a visa is being made, must be accompanied by certified translations.

The translation must include a statement signed by the translator that states that the:

Translation is accurate, and Translator is competent to translate.

so it means you can also translate if you are competent in english and you can also send your old english translate copy to nvc but i think they dont need another one they only need certified copy so dont panic send him birth certificate verified copy if you have any other question you can feel free to ask me good day
