Immigrant visa I 130

Iam a little confused and wanted to see your point of view regarding a petition for alien relative in this case for my step daughter.

For what I understand I send the application and wait for approval and a visa number. once its approved what happens? does the relative get the permanent residency or when she comes here we have to apply for that ? as well as an adjustment of status?

our plan is for her to come here and stay 2-3 months and then go back to be with her mom, then she can come as she pleases when she wants to visit my husband and I.

can u please explain the steps of this visa and if i have to wait longer than 2 -3 months! i was under the impression once the visa is approved automatic residency is given since its my stepdaughter and her dad is here,

Visa I 130 for Step Daughter

Sept 2010-- Getting documents ready. sent BC out for translation.

March 1st 2012-- Sent documents to USCIS

June 15th 2012 EMAIL OF APPROVAL !!

Dec 15th 2012 -- Interview scheduled ( 1-23-2013)

Jan 9th 2013--Medical Exam

Might take as much as 20 years to get a visa number...if you apply for her

If her father who is here applys... thats another story..

Why does her father now apply for his child to come here?

Once the I-130 is approved it is sent to the NVC for processing. You wiil need to submit a letter from the child's mother granting permission to immigrate to the U.S. Here is a link to the I-130 process: I-130 for relative

The process should take about 6-12 months to complete with a USC as stepparent petitioning. Once the child arrives in the US with their immigration visas, they automatically become legal permanent residents.

Going back to live with the mother may be a problem. A conditional resident (LPR) cannot be out of the US for more than 180 days on a single trip without prior AP approval. Maybe someone with more experience in immediate relatives can clarify more.

The child can obtain US citizenship two ways:

1. If Dad becomes a USC before his child's 18th birthday, that child would automatically become a US citizen also.

2.A child can apply for citizenship after living in the US for 5 years as an LPR and is at least 18 years old.

im just a little hesitant if we shld bring her here with that visa to visit or just ask her mom to do the tourist visa for her to come here... also my husband will be able to become a citizen 2011 ...
