Timeline

I want to thank all Vj members for all their suggestions and contributions during the process of my k-1 visa process.

Please I need your help one more time,

I entered here on k-1 visa 9th june 2006,spent just 2 weeeks with my U.s fiance,but we were not

living together as she wanted it so I cooperated,that is not enough,she kept finding faults and

make my stay hre in the U.S frusting and always saying at any little misunderstanding that she won't marry

meany more.

I and her pastor has tried to make this marriage work but she still insisted not to marry me.

This lady has made things so hard for me since the past 5o days plus i have spent here in U.S.

To summarrize all in short. yesteday,she sAid her decision is she can't marry me.

I have been sponsoring myself since I came here till now and she doesn't care

and I don't have any more money to spend and she has decided not to marry me.

And my return tickets has expired on the 5th July 2006.

Based on the Affidafit of support she sign to take care of me till I start working.

I am frusted right,No money to take care of myself,No return ticket back home.

Please what legal action can I take to sustain myself here and to get ticket fare back home before the

90 days expires.I am really hurting emotionally.

I have left all, my good payed job,home (apartment), all for the U.S and

My usc fiance want to frustrute me.

Can I legally make any sort of claims for losing all for for her intentionally frusting me.

resigning from my work and emotional turture.

Please I will need your valueable suggestions and answerrs to this questions.

sorry for ur misfortune. however, i don't really know of much u can do here now except maybe get in touch with USCIS and let them know what is going on and maybe they can help to send u back home since u did come here on a k1 visa and the petitioner is no longer interested. maybe someone else here can suggest something even better and worth trying. sorry again,

Sorry to hear of your dilemma. The problem is two-fold. First, the I-134 is a contract between the US petitioner and the government, and two the contract is not legally binding. In so far as she wishes not to proceed with the marriage, can't you come to some sort of compromise, that with her financial assistance (as in purchasing a ticket for you to return) you will be happy to leave? it would seem to me that this suggestion would suit both parties. u know ur post will bring many replies due to ur last postings. However, i think its best if we could get ur fiance to post. Im sure everyone wants to know the REAL reason why she is no longer interested in marrying you and then they can post some suggestions that just may help. It just seems that something is just not adding up. :unsure: Anyway, I hope u do find the answer to ur problem cos if u r not marrying her...u must leave.

Hi Valentine,

what is going on with your relationship. I remember you all excited about your coming here to marry who you love. What happened to something so sacred. You need to analyse it, talk with your fiance, there must be god damn reason for all of this.

But remember that if it is not going to work out finally, you should find a way of going back home and i quite agree with the above vj posters that your 2nd half should explain some things maybe further help can be provided.

I pray you work things out quickly

Oh Valentine, I am very sorry to hear that things did not work out between you and your fiance. I guess its better to find this out now than to marry her and have the situation between you two get worse. This may not want to be the advice you want to her but you may need to talk with your fiance to see if she can at least get you a return ticket home. I am not sure what your options will be at this point if you decide to stay past the k-1 visa timelines...You may want to seek free immigration consultation from a nonprofit organization like Catholic Charoties in your area if you really decide that dont want to go back to Nigeria to see what you can be done about your status here. Good luck to you.

Sorry Valentine. Here is what I found.

If the relationship fails before permanent residency is granted, there are no other options for adjustment and the K-1 spouse has to leave the U.S.

K-1 fiancee visa holders are in valid status for only 90 days and may not extend their status. K-1 fiancee visa holders should marry and file adjustment of status within 90 days after entry into the U.S.

Valentine, your fiance does not half to purchase your ticket back to Nigeria and there are really few options for you at this point.

Sorry to hear that this has turned out this way for you, Valentine. You don't have much recourse here. The Affadavit of Support is not legally binding and you are not married. Hopefully you can receive help from someone back home to get you a return ticket.

Best to just put this behind you and start over again back home.

Maybe you can try contacting the Nigerian Consulate and see if they can help you....
