I came in on a K-1. Do I need a copy of the USC birth certificates and copies of termination of marriages to file for AOS?? Thanks!!

I don't believe the USC's birth certificate is required; at least, we did not include it in my husband's AOS petition. A copy of the immigrant's birth certificate is required, however.

7. A copy of the intending immigrant's birth certificate along with English translation. (If in any language other than English)

Am I missing something here? It's only asking for the intending immigrant's BC. Could someone show me the exact wording? I didn't send my BC(I am the USC) just that of my husband and of course my divorce documents. Sorry if I sound like a complete idiot, but I just didn't see it there.

You didn't see it because it's not there. I just took a look at the I-485 form; starting on page 2 we read the following:

Initial Evidence

You must file your application with the following evidence:

* Birth Certificate.

Submit a copy of your foreign born birth certificate or other record of your birth that meets the provisions of secondary evidence found in Title 8, Code of Federal Regulations (CFR), 103.2 (b)(2).

And it goes on to list the following:

- Copy of passport page with nonimmigrant visa

- Photos

- Biometric Services

- Police Clearances

- Medical Examination

- Form G-325A

- Evidence of Status

- Affidavit of Support

Not all of these items are required for a K Visa based AOS submission (e.g. police clearances or medical exam....and of course biometrics comes later), but the point is nowhere do they ask for the USC's birth certificate.

If I remember correctly (ahhh, it's all gettin fuzzy further back than last week), the letter for the interview will ask for a copy of the USC's birth certificate. So, if the USC doesn't have one, it's a good idea to get it now.

I actually didn't see anywhere that you needed the USC birth certificate, but I sent it anyways. Again, nowhere does it say not to open the sealed envelope of the I-693, but I did. I just thought they wanted the paper in the envelope. I don't know why it's sealed. They give us a copy of what's in the envelope. Oh well....

When Joel and I went to get his I-693A filled out the receptionist put it in a sealed envelope, taped it, then stamped on it "Do Not Open" in three spots. Then she stamped the name of the civil surgeon on it in three places. She then gave us a photocopy of the form for our records.

If I remember correctly (ahhh, it's all gettin fuzzy further back than last week), the letter for the interview will ask for a copy of the USC's birth certificate. So, if the USC doesn't have one, it's a good idea to get it now.

I have one...but didn't send it because like I posted earlier, it didn't ask for one. If our case gets sent to CSC, which I'm hoping it will since it's pretty straightforward, then it sounds like we'll get an RFE. *sigh* GRRRR...they already have a copy in our K1 petition. Surely all that information is available to them, I would hope so anyway. *sigh*

Here is what I found on the FAQs:

Please see the K1 & K3 Adjustment of Status Guide. In short though you will require the following forms:

Payment

Copy of US Citizens Passport

I-485 Application To Register Permanent Residence or Adjust Status

Copy of non-US Citizens Spouses Visa from passport

If the non-US Citizen Spouse is is a K3 Visa holder include a copy of the I-130 NOA2.

If the non-US Citizen Spouse is is a K1 Visa holder a copy of the I-129F NOA2.

A copy of form I-94, Nonimmigrant Arrival Departure Record (this was put in your passport when you arrived)

Copy of the non-US Citizen Spouses passport (translated if required)

A certified copy of your marriage certificate (translated if required)

If applicable, a copy of the US Citizens and/or non-US Citizen Spouses divorce documents

If applicable, a copy of a prior spouse's death certificate.

2 photos of the non-US Citizen Spouse - (see note) - like you have done before.

G-325A Biographic Information

I-693, Medical Examination of Aliens Seeking Adjustment of Status (or copy of I-693A form for K1/K2 Visa Holders)

I-864 Affidavit of Support

I-765 Application for Employment Authorization. You will apply as category ©(9), "adjustment applicant". (optional, but you cannot work without this)

I-131 Application For Travel Document (this is optional but is for traveling outside the US during the application period, known as "advance parole")(also see question 6.7)

A copy of your birth certificate. (bring an extra when you move, or two or three if you can). You need a translated copy if it is not in English.

Just like the divorce decrees. I don't know why they want them again. Surely they know that to get married again you had to show someone that you were officially divorced. And they also got copies with my K1. More paper!!!!

I agree...Joel and I lamented the fact that we had to submit the SAME information AGAIN, along with MORE pictures. How do they think we got married without my divorce being final? Oh well, that's the lovely USCIS for you. Ever the efficiently run government department.

I know what you mean, about the divorce decrees but I'm going to treat it like it's a whole new app. and send everything. The more complete, the better, they lose paperwork all the time. Also you never know who opens and checks the packages, they may not know you have already sent something before and may just return the app. without checking.

I would think they do not have the previous file, it is probably archived and it would probably take too long to retrieve.
