What if co-sponsor has not yet filed 2009 taxes?

Hi everyone,

Yet again! hehe

So okay,my co-sponsor has not yet filed his taxes for 2009,and he has sent me his tax returns for 2006,2007 and 2008.He wants some clarifications on certain matters,and he thinks that he might have to file for an extension.And so the bottom-line is,he might be able to send me his tax returns for 2009 by the time I have my interview,which might be early May.

So what should I do in such a case?Could he send me a copy of his request for extension?Is that original also required or could a copy be fine?I am not even sure what it looks like,so excuse me if this sounds stupid.

Thanks and I would really appreciate some suggestions!

Sorry we didn't drop everything and come to answer your question.

Submit what you have and a copy of his extension form for 2009. If you will read the instructions it suggests presenting the most recent year's tax return or an explanation of why it wasn't filed. An automatic extension is a reason it wasn't filed and you presented the most recent year available, 2008. Plus 2007 and 2006 for some reason.

Hopefully he has also included his documentation of CURRENT income (what he made in the past three years, or four years, means nothing if he doesn't have adequate CURRENT income) and proof that he is a US citizen or Permanent Resident. Nothing else matters without that.

Incidentally this topic is covered several times a week in the Consulate forum and thousands of similar answers can be found with a search in less time than it takes to scold us for not answering sooner.

I cannot provide answers to events that lie in the future.

What I can tell you is that you take his '09 tax returns to the interview, if you have them. If he files for an extension, you don't have them, and don't need them, as that's in full compliance with our tax laws.

Yes. Tax returns are due April 15. After April 15 you should be presenting the tax return for the previous year (2009 in this case) If you do not, you should be providing an explanation of why you are not presenting the previous year tax return. The explanation needs to cite the tax code and the allowed reason for not filing ("I was a student and didn't make much money" is NOT sufficient. "I was a student with an income of $XXX and the threshold for filing income tax is $XXXX per XX US code, chapter XX verse XX" IS an acceptable explanation)

All taxpayers are given an automatic extension until October 15 IF they file the proper form to do so. After April 15 the explanation that you have requested an automatic extension and a copy of the form filed for the extension would be adequate. It would be reasonable to expect the consulates to allow a person a certain amount of "grace period", especially for an interview done on April 16th and an I-134 prepared a month earlier, but such grace period is not assured or defined. If being a co-sponsor is, or was, in your future procrastinating on taxes is not a good idea.
