I have an 18 month old son. He was born in another country and only returned to the US a few months ago. His mother is a citizen of the US and Poland. I have been giving her money every week since she returned with him. We will be going to court at some point to formalize the child support payments at some point in the near future. How do I answer the question of “do you have a dependent child, enter the number here”? My son lives with his mother and has never stayed with me. Is he a dependent child? If he is not now, but becomes one at some point during the AOS process does this cause problems? What is the best way to handle situations where the answer may change? Does just paying child support constitute a dependent child?

The child has to be counted unless you can prove you have no legal obligation to support the child.

Since you are giving child support, you would be supporting the child, and would count them.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
