Timeline

Just a quick question:

I need to know if i will need 3 years tax papers:

I Have 2 years

or will by signing the affidavit sufficient enough

on the i134 form.

Can i expect that to appear as RFE ??

or in packet 3 ?

Also the imbra... if you didn't have one does the process go faster

any opinion is greatly appreciated

Umm, ok

1. The two years should be sufficient. I sent 2005 return only along with my W2s from 04 and 03 and they said, "everything looks perfect."

The I-134 must be signed and NOTARIZED. Take it to the bank, they have notaries, or you may even have one at work!

They will not get the I134 until your fiance/fiancee takes it to the interview if something was wrong thats where they would tell them there. You don't send them the I-134, it's taken to the interview.

The only way IMBRA isn't affecting you is if your petition was sent in before March 6th. As our's went in on Feb. 28th and is now complete I'm guessing you were after March 6th so yes, IMBRA has been part of your process.

12/14/2006 AOS Forwarded to CSC AND AP Application approved.

01/17/2007 First touch of 2007 at CSC

01/20/2007 Touched AGAIN (also the 18th) come on...

February: Oops, RFE for a REGISTERED marriage certificate. Oops! Overnighted it.

02/28/2007 Paul gets email letting us know his GREENCARD is on it's way! It's done...for now!

03/09/2007 Paul's greencard arrives. And breathe...

We began with mailing the I-129 in on February 27, 2006 so the whole process took us approx. one year.

in regards to imbra: doesnt that stand for marriage broker

I didnt use a marriage broker.. so what do i expect if I didnt

i sent the i129-f received noa1

so whats the next step

wait, patiently!

You shouldn't receieve an RFE but some new form filers are getting them anyways.

Once you get NOA1, you can log in online & check your status.

You don't send them the I-134, it's taken to the interview.

Your job right now, is easy. Wait and mail him what he needs. Good job on getting the police cert going as it took the full 40 days for Paul's to arrive.

Right, well, once he gets packet 3 he'll fill it out and send it back. Unless he's trying to do the medical and interview in the same week, I'd book the medical now and get it done, it's good for a year so it get it out of the way while you're waiting. They'll ask, have you received packet 3, just say yes, it's fine. Odds are by the time you book it you'll have packet 3 by then with maps, etc.

So, when packet 3 arrives fill out the paperwork and send it back ASAP, the quicker return the quicker interview. I'd send back the checklist as well - by the time the interview comes up he'll have everything on it as your police cert is already almost there and thats the hold out.

At this point you should be mailing him your I-134, copy of your NOA 2 reaffirmation of intent to marry letter, supporting documents and anything else he needs, I.E. your phone bills, cards he snail mailed you, pictures you have that he doesn't anything that you are using as evidence of continuning relationship. Thats your only part left, really! ALL of that will go with him to the interview, for packet 3 he's just going to mail back the forms they send him.

And to be honest, when Paul had his interview they didn't even want to see evidence of our continued relationship. They took my I-134 and that was that.

The nice part of this is that if you have a co-sponsor you might not need but just have to be safe, they dont' even have to come into play. My mother was prepared to be our co-sponsor and Paul had all of her stuff with him but he gave them JUST my I-134 first. As that was just fine, we never had to bring her into it. If for some reason I hadn't been (though I make enough, but better to be safe) he could have handed over her's. So I'm glad we got to keep it simple.

The amount of past tax returns required all depends on your Consulate. Every Consulate can be a bit different. Some only ask for last years, some ask for 3 years etc. Best thing to do would be to shoot the Consulate a quick email and see what they expect to see at the interview.

Also, it is usually best not to fill out your I-134 right away. The reason is some of the proof your going to send along with it (letter from the bank, bank statement, letter from employer etc.) can be time sensitive. Especially with you just filing now, it could take 4 or 5 months for an approval seeing how they are still working through the IMBRA muck. A lot can happen in 4 or 5 months, so it's better to gather all the documents for the I-134 a month or so before the interview, that way there is no question about the information being current.

You will still be affected by IMBRA, as it pertains to more than just getting married through a Marriage Broker. I'm guessing the longest part of the delay will be just waiting for them to finish processing all the IMBRA RFE petitions they are working on right now.

My fiancee is from the philippines and when I checked with the embassy website there, it mentions they only need my most recent tax return. I'd say check with involved embassy website or call them and see what they require.

Concerning the RFE, if you filed after March 6, the IMBRA RFE will only ask you three questions but none of them pertain to any thing financial. It only asks if you met your fiancee through an IMB (International Marriage Broker) and if you have any involvment with anything criminal in nature. As far as the process going faster? Who knows...I'm a marchie and I still haven't gotten my NOA2 yet. However there have been a number of Marchies who got their NOA2 already.

As I understand it, you send the I-134 to your fiancee so she can present it during her interview....at least that's what goes on in my case. Different countries have different requirements and processes. So check with yours and see what they say. Hope this helps a little
