Hi all...

I'm just worried and confused about some things right now. Need your help again guys.

1. My fiance visited me only once (April 2008). My question is, is it ok to bring to the interview our pictures together even though they were taken more than 2 years ago?

2. My fiance has been temporarily laid off from his job since December 2009. We don't know when he's going back to work. Should we wait till he gets back to work before setting up an appointment at the embassy or just go on with the interview? And if we do go on with the interview, he doesn't have any recent pay stub :(

Looks like you guys filed 129F last April. According to USCIS, you must have physically met within 2 years PRIOR to filing your petition. If the photos you have are in that timeframe then you should be ok as far as that requirement is concerned. But you need to build up your "establishing relationship" part for the interview.

I think the laid off work is a bigger issue than the photos. The CO will look at last year's tax transcipts (if you have them) and last year's W2s and see if his salary is above the poverty line (or specifically 125% of the poverty line). Being laid off from work does pose a problem not just in passing the interview but in being able to take care of and proivde a life for new bride. It is possible to pass the interview based solely on last few year's income and tax records but you may also be asked for recent pay stubs, depends on the CO. Tough call on both your parts but deceiving the US State Department is not a good idea and in the long term, really, you want to know that you are not moving into a situation where you could end up homeless or living with your fiance's parents (read the many wonderful stories here on VJ about those lucky couples living with the fiance's parents). I'm not preaching, but this is your future.

your two years are fine they go from file time,and he he can show 2008 tax transcibt,with 2007,2006 dont worry about 2009 tax yet just get bring his latest pay stubs and do your interview right away

Thank you for your replies. We don't have any problem with his income tax returns, he has his 2009 and his salary is above the poverty line. What we are concerned about are the pay stubs because he has been laid off since December.

You can just present the pyastubs that he got months before he got laid off together with all the tax documents..

The OP's petition has been approved, so the two year face to face meeting is no longer an issue....

What will be an issue is how they have been maintaining the relationship over the last two years and whether the CO will believe it is "bonafide". In addition, the I-134 could be an issue depending on how current the CO wants to see the evidence... If the consulate wants to see current "pay stubs" to demonstrate that the financial ability is still in place, then they will have also have issues with this.

I don't think there will be an issue regarding evidences of ongoing relationship because we talk on YM and on the phone almost everyday, we also have the money transfer receipts. The only issue we are concerned about are the recent pay stubs because he's been off from work for 3 months now.

You can also present bank accounts of your fiance.
