My husband has received approval for advance parole, and would like to make a quick trip back to Cuba to visit family while waiting for his AOS interview. We were a little aprehensive about using the AP after reading the disclaimer on the form. "Parole into the US is not guaranteed." Everything that I have read on VJ would make it seem that it isn't really a problem.

However, when talking to an aide for our congressman, she was very emphatic that we should consult an immigration lawyer before leaving the country on the AP, since there was a possibility that he wouldn't be able to get back in.

My questions are to others who have actually used the AP or know someone who has:

Can you tell me how that went for you?

The paper says that AP is to be used for "urgent humanitarian reasons or significant public benefit". Were you questioned when you came back about why you went? Or does the fact that the AP was issued mean that this issue has already been decided? Basically, I was wondering if they would deny him re-entry if they thought his reasons for leaving weren't serious enough.

Has anyone used the AP to return to Cuba? How did that go?

Can someone with info on this give feedback. I am seeking info on this as well. I a friend who just receieved his greencard told me that his lawyer told him not to leave until he got his greencard even though he had the AP, which I found strange because the AP is for travel. But I guess its better to safe than sorry. i dont know if I can stay here another 3-4 months without going home.

JAN 27th 2010 Medical completed Jan 27th

FEB 17th 2010 AOS + I-130 package sent

FEB 25th Got emails with all receipt # ( but not able to check on USCIS site)

FEB 28th Online status check available

MAR 1st Received Hard Copy of NOA's in the mail

MAR 8th Received Biometrics appointment in mail: for Mar 18th (however no updates on site or email notifications)

MAR 9th Biometrics complete via walk-in (All docs touched on USCIS site)

MAR 26th Received interview appointment (For May 6th)

APR 23rd Touched on I-130 and I-485

APR 26th Touched on all docs, EAD card production ordered

MAY 1st Advance patrol in mail

MAY 6th Interview (Request for additional information)

MAY 6th EAD in mail

June 1st (RFE mailed in)

June 28th Notice of approval on USCIS website

July 3th GREEN CARD INT HE MAIL!!!

Timeline

Its usually fine, as long as he doesnt do anything out of the country (like get arrested on a felony or something) that would make him unable to enter the states. They tell people though who have come in on a tourist visa and then adjust not to exit the country usually because of the fact most of them have accrued out of status time which can lead to a ban. He should be fine to go for a visit though.

We had the same concerns you are having after we read that disclaimer on the form. My wife didn't have a problem using the AP to enter back from Cuba, but they did asked why she was in Cuba. In Miami, when you enter with the AP they take you to the immigration office within the airport, and you fill out some forms. They stamped & placed a paper in your passport. Other than the hour wait, the process was simple and easy.
