My husband was interveiwed at the New Zealand Consulate for our I-129f and the case was sent back for review because he was an overstay before I met him. Four months later I have not received an update on my case and they requested one because it was outside of processing time. I checked back on the I-129f a month later and not only was the case not updated but the NVC just now sent back my I-130 to USCIS for review. There was never an interveiw for the I-130 and now they tell me I have to wait another 6 months to get any type answer from them.

Is this a sign they are going to deny the visa AND the residency?

And do I still have to pay the $400 visa processing fee to the NVC for the I-130 eventhough they dont have the case?

You don't "have to" do anything. If the I-129F was sent back to California, they will probably just notify you its approval has expired. Depending on the length of overstay and other factors, you may qualify for a hardship waiver but not an immediate visa upon interview. This is the kind of case where consultation with a professional is a great idea.
