I have got to file a waiver because of a unused k1 visa before so my question is-- can i file the waiver at same time as the new k1 or do i have to file the waiver before?

Same time. The waiver is just a letter statement from you.

The waiver is really answering yes to Part A - question 11 on the I-129F. Although if this is your second I-129F in two years or your third or more I-129F petition ever, than yes you need the waiver. If this is your second I-129F petition in MORE than two years, technically the law does not require a waiver. But you still should answer question 11 with the required information.

*blink* - do you mean the "request for a waiver"?

You can't give yourself a waiver - you can only request one :)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
